A BILL FOR AN ACT

 

 

RELATING TO EMERGENCY POWERS.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 127A, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§127A-     Medical facilities; elective surgeries.  (a)  In the event that the governor declares a state of emergency for the entire State or any portion thereof, or a mayor declares a local state of emergency for the county or any portion thereof, or when the State, or any portion thereof, is the subject of a health or pandemic emergency:

     (1)  The governor shall ensure the continuity of service by medical facilities, both publicly and privately owned, by regulating the continuation of services; and

     (2)  Any hospital, in its discretion, may suspend providing elective surgeries to address operational limits of the facility's bed capacity.

     (b)  As used in this section, "hospital" means a facility licensed under section 321-14.5."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect on June 30, 3000.

Description:

Requires the Governor to ensure continued operation of medical facilities upon declaration of a state of emergency or local state of emergency and during times of health or pandemic emergencies.  Allows hospitals to suspend elective surgeries during the period of emergency to address the facility's bed capacity.  Effective 6/30/3000.  (HD1)
