Sir:

 

     Your Committee on Judiciary, to which was referred H.B. No. 2006, H.D. 1, S.D. 1, entitled:

 

"A BILL FOR AN ACT RELATING TO PERMITS,"

 

begs leave to report as follows:

 

     The purpose and intent of this measure is to:

 

     (1)  Require, for emergency permits to install sandbags, that the Board of Land and Natural Resources include as a condition on the emergency permit a requirement for the attachment of identifying information, including the permittee's contact information and the permit number, to the sandbag; and

 

     (2)  Require the Board of Land and Natural Resources to specify the form and manner in which the identifying information is to be attached to the sandbag.

 

     Your Committee received testimony in support of this measure from the Department of Land and Natural Resources.

 

     Your Committee finds that temporary erosion control devices with sandbag "burritos," which are large tubes of sand wrapped in fabric, have been authorized on a temporary emergency basis to address coastal erosion pursuant to chapter 13-5, Hawaii Administrative Rules, which allows the Chairperson of the Board of Land and Natural Resources to issue emergency permits when there is an imminent threat to public health or safety.  This has been an important tool when addressing short-term emergencies such as floods, landslides, tsunami, and storms.  There have been reports of torn bags and debris washed up on the beach that have not been authorized by the Board of Land and Natural Resources for use in the shoreline area.  The addition of identifying information to sandbags utilized for erosion control will allow for greater enforcement and accountability.

 

     As affirmed by the record of votes of the members of your Committee on Judiciary that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 2006, H.D. 1, S.D. 1, and recommends that it pass Third Reading.
