A BILL FOR AN ACT

 

 

relating to abandoned and derelict vehicles.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that open space is a finite and precious commodity in Hawaii.  The legislature also finds that of the 1,267,136 registered motor vehicles in the State in 2018, sixty-three per cent were registered in the city and county of Honolulu.  The legislature recognizes that traffic congestion in Honolulu consistently ranks as among the worst in the nation and that this congestion is made worse by the presence of abandoned and derelict vehicles on the State's highways.

     Accordingly, the purpose of this Act is to establish an abandoned and derelict vehicles task force to make recommendations to ensure the proper identification and disposal of abandoned and derelict vehicles left on the State's highways.

     SECTION 2.  (a)  There is established within the department of transportation for administrative purposes an abandoned and derelict vehicles task force to make recommendations to ensure the proper identification and disposal of abandoned and derelict vehicles left on the State's highways.

     (b)  The task force shall:

     (1)  Consider the following:

          (A)  A comparison of the statutory definitions of "abandoned vehicle" and "derelict vehicle"; and

          (B)  The methods for determining whether a vehicle that is left on a freeway is abandoned or derelict; and

     (2)  Submit a report of its findings and recommendations, including any proposed legislation, to the legislature no later than twenty days prior to the convening of the regular session of 2022.

     (c)  The following individuals shall serve as members of the task force:

     (1)  The director of transportation or the director's designee, who shall serve as chair of the task force;

     (2)  The mayor of each county, or the respective mayor's designee; and

     (3)  A representative from each of the county police departments in the State.

The task force shall invite a representative from the automobile towing industry to serve on the task force.

     SECTION 3.  There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2021-2022 for the administration and operation of the abandoned and derelict vehicles task force.

     The sum appropriated shall be expended by the department of transportation for the purposes of this Act.

     SECTION 4.  This Act shall take effect on July 1, 2021.
