RELATING TO RECYCLING. Mandates the recommendations made by the office of the auditor to the department of health regarding advance disposal fee glass containers and glass recycling. Requires the department of health to report on its implementation of the recommendations to the legislature.

RELATING TO APPRAISAL MANAGEMENT COMPANIES. Establishes an appraisal management company registration program within the department of commerce and consumer affairs to conform to minimum standards established under federal law and regulations. Establishes registration requirements, standards, and penalties for violations. Appropriates funds to the department for costs associated with the registration program, to take effect on 7/1/2017. Takes effect on 1/1/2018. (SD1)

RELATING TO ATHLETE AGENTS. Expands the definition of "athlete agent" (who shall register with the director of commerce and consumer affairs) to include individuals who, for compensation or the anticipation of compensation, serve a student athlete as a financial advisor or business manager. Requires reciprocity for athlete agents who are registered in more than one state. Strengthens requirements for athlete agent contracts. Strengthens requirements under which athlete agents shall notify educational institution at which student athlete is enrolled.

RELATING TO CONDOMINIUMS. Part I: Purpose section. Part II: Clarifies that when a unit owner and association reach a payment plan to cure a nonjudicial foreclosure, completion of the payment plan is required to cure the default; specifies that if a unit owner and an association have agreed on a payment plan to prevent a nonjudicial foreclosure from proceeding, any association fines imposed while the payment plan is in effect shall not be deemed a default under the payment plan; and clarifies the obligations of a unit owner and an association while a unit owner is not otherwise in default under a payment plan. Part III: Clarifies that the pay first, dispute later provisions in Hawaii's condominium law apply only to common expense assessments claimed by an association of apartment owners; specifies that a unit or apartment owner who disputes the amount of an assessment may request a written statement about the assessment from the association, including that a unit or apartment owner may demand mediation prior to paying contested charges, other than common expense assessments; specifies requirements for mediation on contested charges, except for common expense assessments; and repeals language that permitted associations to convert delinquent fines and late fees into delinquent common expense assessments, if certain conditions were met. Part IV: Makes conforming amendments.

RELATING TO IN VITRO FERTILIZATION INSURANCE COVERAGE. Removes discriminatory requirements for mandatory insurance coverage of in vitro fertilization procedures to create parity of coverage for same-sex couples, unmarried women, and male-female couples for whom male infertility is the relevant factor. RELATING TO VICTIMS OF SEXUAL VIOLENCE. Requires health insurance coverage for case management services by licensed mental health providers for victims of sexual violence.

RELATING TO HEARING AIDS. Requires health insurance policies and contracts issued after 12/31/18 to provide coverage for the cost of hearing aids at a minimum of $1,500 per hearing aid for each hearing-impaired ear every thirty-six months. (SD1)

RELATING TO NATUROPATHIC PHYSICIANS. Requires insurers, mutual benefit societies, fraternal benefit societies, and health maintenance organizations to provide coverage for health care services provided by a naturopathic physician.

RELATING TO THE AUTHORITY TO ADJUST PROFESSIONAL AND VOCATIONAL LICENSING FEES. Updates section 92-28, Hawaii Revised Statutes, to include all of the Department of Commerce and Consumer Affairs' professional and vocational licensing chapters to allow for the flexibility of decreasing or increasing fees in a timely manner, subject to the approval of the Governor.

RELATING TO CITATIONS FOR BEAUTY CULTURE VIOLATIONS. Authorizes the issuance of a citation for specific violations of beauty culture laws by licensees and permittees. Sets forth a process for licensees and permittees to contest the citation and provides for the assessment of fines for each violation. (SD1)

RELATING TO MORTGAGE SERVICERS. Updates requirements under chapter 454M, Hawaii Revised Statutes, relating to mortgage servicers, including: requiring the commissioner of financial institutions to approve a change in control of a licensee; identifying when an individual is presumed to control a mortgage servicer; clarifying which persons associated with a mortgage servicer are subject to interviews and examination and various disclosure requirements; and adding a definition for "executive officer". Takes effect 09/01/2017. (SD1)

RELATING TO MORTGAGE LOAN ORIGINATION. Clarifies and updates requirements under chapter 454F, Hawaii Revised Statutes, for mortgage loan origination. Clarifies persons subject to criminal history disclosures and criminal history background checks on applications for licensure and change of control of the licensee, and when a person is presumed to control a mortgage loan originator company (MLOC). Clarifies responsibilities of a "qualified individual", amends the definition, and requires an exempt sponsoring MLOC to have a qualified individual and a principal place of business in the State. Clarifies supervisory requirements of nonprofit organizations under chapter 454F, Hawaii Revised Statutes, and when a nonprofit employee is exempt from registration and licensure as a mortgage loan originator. Clarifies the applicable fee for a criminal history background check. Defines "executive officer".

RELATING TO INSURANCE. Conforms monetary penalties for insurance fraud with penal code monetary penalties for a class C felony and misdemeanor. Clarifies process for insurers applying for an original certificate of authority and transferring insurers amending corporate documents after a transfer. Specifies fee for a certificate of authority for an application for motor vehicle self-insurance. Permits insurance commissioner to issue a declaration before an event that may require the use of nonresident adjusters. Beginning 1/1/2019, conforms producer licensing requirements to the National Association of Insurance Commissioners' Producer Licensing Model Act. Allows third-party claimants to claim general excise tax and certificate of ownership fee in total loss claims. Requires certain costs and expenses incurred by the commissioner during supervisory procedures to be paid or reimbursed by insurer assets. Makes housekeeping amendments. Effective 7/1/2050. (SD1)
