Expands the law on planned community associations to apply to homeowners' associations.  (HB192 HD1)

RELATING TO NONPROFIT CORPORATIONS.

Amends the nonprofit corporations law to impose a duty of loyalty on directors and officers of nonprofit corporations, recodify provisions that would allow nonprofit corporations to convert into and out of domestic nonprofit corporations, and give the Attorney General additional time to review proposed dissolutions of nonprofits.  (HB1027 HD1)

Status

RELATING TO CHARITABLE ORGANIZATIONS.

Defines "property" as used in section 28-5.2, Hawaii Revised Statutes, regarding protection of charitable assets.  Requires certain disclosures on collection bins for donated clothing and household items by for-profit and nonprofit organizations, authorizes an officer or an agent to file an initial registration statement for a charity, requires notice to the Attorney General and specifies a procedure when a charity seeks deactivation from registration, authorizes the Attorney General to require electronic signature for financial reports filed by professional solicitors, clarifies what is being certified by the electronic signature and therefore subject to section 710-1063, Hawaii Revised Statutes, regarding penalties for unsworn statements shall apply, allows charitable organizations that file an IRS Form 990-PF to file annual reports with the Attorney General on the same schedule as charities that file an IRS Form 990 or 990EZ, repeals obsolete and updates references to accrediting organizations, and clarifies that the exemption from registration for organizations that support educational institutions is a separate exemption from that of the educational institutions themselves.  (HB1028 HD1)

RELATING TO FIRE SPRINKLERS.

Extends the prohibition that prevents the counties from requiring fire sprinklers in specific family dwelling units and non-residential agricultural and aquacultural buildings.  (HB1384 HD2)

RELATING TO COUNTY ACCESS TO PRIVATE PROPERTY.

Authorizes the counties to enter private property to control or eradicate invasive species and pests.  (HB606 HD1)

RELATING TO CITATIONS FOR BEAUTY CULTURE VIOLATIONS.

Authorizes the issuance of a citation for specific violations of beauty culture laws by licensees and permittees.  Sets forth a process for licensees and permittees to contest the citation and provides for the assessment of fines for each violation.  Establishes requirements for persons selling or demonstrating beauty products or techniques for promotional purposes to adhere to licensing requirements with certain exceptions.  (HB1081 HD2)

Clarifies laws regarding an arbitrator's failure to disclose certain facts prior to or during arbitration.

RELATING TO CRIMINAL TRESPASS.

Amends the conditions under which the definition of "enter or remain unlawfully" shall apply with reference to criminal trespass in the second degree.

RELATING TO PUBLIC SAFETY.

Requires police departments to disclose to the Legislature the identity of an officer upon the officer's second suspension in a five-year period or discharge.  Requires disclosure under the Uniform Information Practices Act after a police officer's second suspension in a five-year period.

RELATING TO RESISTING ARREST.

Creates the offense of resisting arrest in the first degree as a class C felony.  Amends the existing resisting arrest misdemeanor offense to resisting arrest in the second degree.

Permits an administrative order to overcome a patient's objection to psychiatric treatment.

Clarifies provisions regarding examinations of defendants' fitness to proceed in the prosecution.

RELATING TO ELECTIONS.

Requires candidates for President and Vice President of the United States to disclose their tax returns in order to have their names appear on a Hawaii ballot.

Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing.  Testimony should indicate:

·     Testifier's name with position/title and organization;

·     The Committee(s) to which the comments are directed;

·     The date and time of the hearing; and

·     Measure number. 

 

While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may be distributed to the Committee after the hearing.
