Clarifies that under the Hawaii Post-Secondary Education Authorization Program, when an institution ceases to operate, the student transcripts shall be kept permanently in a form prescribed by the director and other records requested and obtained by DCCA may be disposed of at the director's discretion.  (SD1)

RELATING TO ZONING.

Clarifies county zoning authority by distinguishing single-family residential use from single-family vacation rental use and allowing amortization by ordinance for single-family transient vacation rentals over a reasonable period.  Effective July 1, 2050.  (SD1)

RELATING TO AGRICULTURE.

Restricts any subdivision, including by condominium property regime, of parcels of agricultural lands one hundred acres or greater in size.  Requires the owner to make and implement a farm plan prior to the construction of any homes on the resulting legal lots of record.

Prohibits the creation of a condominium property regime on agricultural land 25 acres or greater.  Prohibits a condominium property regime on agricultural land from being amended to allow a residential dwelling.  Prohibits the subdivision of agricultural land 25 acres or greater for the purpose of creating a condominium property regime.  Prohibits any residential project created as a condominium under chapter 514B, HRS, or a planned community association under chapter 421J, HRS, in class A or B agricultural lands.  (SD1)

RELATING TO PUBLIC UTILITIES.

Requires the PUC to establish preferential off-peak rates for the purchase of energy that is used or consumed for agricultural activities.  Requires the PUC to require electric and gas utilities to develop energy storage technology incentive programs to provide incentives to agricultural customers to acquire energy storage technology for use at the agricultural customers' sites.  (SD1)

RELATING TO EMPLOYMENT SECURITY.

Clarifies Hawaii's employment security law for independent contractors.  Includes twenty factors to be used as guidelines when determining whether an individual could be an independent contractor.  Retains the ability of the department of labor and industrial relations to determine if an individual is an independent contractor.  Requires the director of labor and industrial relations to report to the legislature prior to the regular session of 2017 regarding guidelines developed by the unemployment insurance coverage committee.  Requires an annual report to the legislature regarding covered employment determinations.  (SD1)

RELATING TO BROADBAND.

Extends until 6/30/2023 the provisions of Act 264, SLH 2013, which requires the State and the counties to take action within sixty days for broadband-related permit applications, requires the State to take action within one hundred forty-five days for use applications for broadband facilities within the conservation district, establishes other requirements regarding broadband-related permits, and subjects weight load for utility poles to capacities established by the FCC and PUC.  (SD1)
