Reduces the surcharge on the license and renewal fee for behavior analysts from $100 to $50.

RELATING TO MEDICAL INVESTIGATIONS BY THE REGULATED INDUSTRIES COMPLAINTS OFFICE.

Requires the regulated industries complaints office to establish a division that specializes in medical cases involving regulated professions and occupations.  Appropriates funds for field investigator positions who specialize in medical cases.

RELATING TO LICENSING.

Requires dentist, physician, osteopathic physician, physician assistant, nurse, and pharmacist licensee applicants who have had a license, permit, or ability to practice suspended in another jurisdiction to undergo a hearing to show cause why suspension should be terminated prior to being issued a license to practice in Hawaii.  Requires the board of dental examiners, Hawaii medical board, board of nursing, and board of pharmacy to summarily suspend a Hawaii license upon a determination that a licensee has had a license, registration, or ability to practice suspended or revoked in any other jurisdiction, pending a hearing to show cause.  Requires orders of summary suspension or disciplinary action taken due to actions arising in other jurisdictions to be public record.

RELATING TO NURSING.

Establishes criminal history record check requirements for all nurse licensure, including licensure renewal, applicants.  Authorizes the state board of nursing to develop rules necessary to implement the required criminal history record checks.

Creates the board of dental hygienist examiners to oversee dental hygienists separate and apart from the board of dental examiners who oversee dentists.

Adds a new section to chapter 662, Hawaii Revised Statutes, providing professionally licensed or certified government employees with the same privileges and immunities as other state employees.

RELATING TO INSURANCE.

Adopts the National Association of Insurance Commissioners' ("NAIC") Risk Management and Own Risk and Solvency Assessment Act; applies chapter 431, Hawaii Revised Statutes, provisions to risk retention captive insurance companies; includes new corporate governance language from the NAIC Model Risk Retention Act.

Authorizes employers to establish group health savings accounts in addition to group accident and health or sickness insurance policies, group hospital and medical service plan contracts, and HMO plans issued or renewed after July 1, 2016.

RELATING TO INSURANCE.

Prohibits health insurers, mutual benefit societies, and health maintenance organizations from discriminating with respect to participation and coverage under a policy, contract, plan, or agreement against any person on the basis of actual gender identity or perceived gender identity.

Authorizes the State to submit and implement a waiver from certain provisions of the Patient Protection and Affordable Care Act of 2010.

RELATING TO INSURANCE.

Makes various updates to title 24, Hawaii Revised Statutes, including: requiring property insurers to establish catastrophe reserve funds; requiring an insurer seeking to discontinue writing property coverage to file an affidavit; requiring the Insurance Commissioner's authorization for insurers providing residential property coverage; requiring insurers to file their premium tax statements electronically and to pay electronically; applying consumer protections to short-term health policies with preexisting conditions provisions; including physician assistant-delivered services under coverage for child health supervision for accident and health or sickness policies and for mutual benefit societies; requiring an entity to notify a claim filer under certain conditions; prohibiting a risk retention group from being a sponsor of and allowing it to be a participant in a sponsored captive insurance company; providing mental illness benefits coverage to licensed dietitians; requiring an entity's duty to respond to the Insurance Commissioner during an investigation or examination; providing visual or optometric services coverage for licensed physicians and optometrists and surgical or emergency services coverage for dentists under health plans of mutual benefit societies; providing coverage for pharmacist-delivered contraceptive services; and making other housekeeping and conforming amendments.

RELATING TO THE JOINT FORMULARY ADVISORY COMMITTEE.

Repeals the Joint Formulary Advisory Committee established under chapter 457, Hawaii Revised Statutes, and allows the Board of Nursing to determine the exclusionary formulary for qualified advanced practice registered nurses with prescriptive authority.

RELATING TO CITATIONS FOR MASSAGE THERAPY VIOLATIONS.

Authorizes the issuance of a citation for specific violations of massage therapy laws by licensees.  Sets forth a process for licensees to contest the citation and provides for the assessment of fines for each violation.

SB 2864

      Status & Testimony

RELATING TO PHYSICIAN DISCIPLINE.

Authorizes the Hawaii Medical Board to impose the same disciplinary action against a licensee as was taken by another state or federal agency.  Establishes conditions for the disciplinary action.  Prohibits the licensee from practicing until a final order of discipline is issued if the licensee has been prohibited from practicing in another state.
