A BILL FOR AN ACT

 

 

RELATING TO the state ethics commission.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Act 151, Session Laws of Hawaii 2015, appropriated $130,000 in general funds for fiscal year 2015-2016 to the state ethics commission for the design and development of an electronic filing system for lobbyists.  The executive director of the state ethics commission, however, has indicated that the total amount of the appropriation will not be expended due to the implementation of an alternative, less costly design and development approach.

     The legislature finds that the funds that are not required for the electronic filing system should be reappropriated for other costs expected to be incurred by the state ethics commission.  The costs include vacation payouts for retiring employees and administrative and operational expenses for a task force that may be established by the legislature to assist and advise the commission.

     The purpose of this Act is to:

     (1)  Reduce the appropriation in Act 151, Session Laws of Hawaii 2015, from $130,000 to $50,000 to design and develop the electronic filing system for lobbyists;

     (2)  Appropriate $45,000 for the current fiscal year 2015-2016 for vacation payouts for retiring employees of the commission; and

     (3)  Appropriate $35,000 for fiscal year 2016-2017 to fund a task force that may be established by the legislature to assist and advise the commission.

     SECTION 2.  There is appropriated out of the general revenues of the State of Hawaii the sum of $45,000 or so much thereof as may be necessary for fiscal year 2015-2016 for vacation payouts to retiring employees of the ethics commission.

     The sum appropriated shall be expended by the state ethics commission for the purposes of this section.

     SECTION 3.  There is appropriated out of the general revenues of the State of Hawaii the sum of $35,000 or so much thereof as may be necessary for fiscal year 2016-2017 for the payment of expenses incurred for administering and operating a task force that may be established by the legislature to provide assistance and advice to the state ethics commission.

     The sum appropriated shall be expended by the state ethics commission for the purposes of this section.

     SECTION 4.  Act 151, Session Laws of Hawaii 2015, is amended by amending section 2 to read as follows:

     "SECTION 2.  There is appropriated out of the general revenues of the State of Hawaii the sum of [$130,000] $50,000 or so much thereof as may be necessary for fiscal year 2015-2016 to design and develop a system that allows filers to electronically file required statements and reports with the state ethics commission.

     The sum appropriated shall be expended by the state ethics commission for the purposes of this Act."

     SECTION 5.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 6.  This Act shall take effect upon its approval.
