RELATING TO EMERGENCY VEHICLES. Amends the definition of "emergency vehicle" in the law that requires approaching vehicles to slow and change lanes to include state civil defense vehicles and county emergency management vehicles.

RELATING TO BLIND PEDESTRIAN SAFETY. Requires drivers of vehicles to exercise due care to ensure the safety of blind or visually handicapped on any roadway. Requires the examination for a driver's license to test the applicant's knowledge of operating a vehicle in a manner that ensures the safety of blind or visually impaired pedestrians.

RELATING TO THE MILITARY. Allows reservists and national guard members in active service who desire to run for office to file nomination papers and take their oaths by mail.

RELATING TO CONSUMER PROTECTION. Requires persons charging a consumer's credit or debit card or account for automatic renewal or continuous service offers under a consumer agreement to first obtain acknowledgment and affirmative consent of the consumer. Establishes notice, disclosure and contact information requirements for such consumer agreements. Requires for free trial offers that include automatic renewal or continuous service offers, disclosure of method of cancellation and opportunity to cancel before commencing automatic billing. RELATING TO SEXUAL ASSAULT. Mandates instead of permits a family court to terminate the parental rights to any child of a natural parent if the natural parent is convicted of rape or sexual assault and that rape or sexual assault resulted in the conception of the child.

RELATING TO THE PENAL CODE. Increases the monetary threshold to $750 with respect to property or services for theft in the second degree, effective 2016. Provides for 2% automatic yearly increase thereafter.

RELATING TO THE DEPARTMENT OF EDUCATION. Bars prohibition of student or class participation in a fundraiser or charitable activity in conjunction with a nonprofit organization as part of a school project when participation benefits student learning. Requires the department to take all steps necessary to prevent the preferential treatment of specific charities and undue pressure on school children or their families to participate in charitable activities. RELATING TO THE PENAL CODE. Provides that the treatment of a corpse in a manner consistent with traditional Hawaiian cultural customs and practices shall not constitute the abuse of a corpse within the penal code.

RELATING TO THE HAWAII PUBLIC HOUSING AUTHORITY. Clarifies trespassing in the second degree at Hawaii public housing authority housing projects as a nonresident who enters or remains on the property unlawfully or without authorization. Clarifies requirements for signage notifying trespassers of illegal entry. (HB767 HD1)

RELATING TO POLICE DEPARTMENTS. Specifies that citizen complaints against a police officer that involve allegations of domestic abuse against a family or household member on the part of the police officer shall not be required to be in writing or sworn to by the complainant.

RELATING TO DOMESTIC VIOLENCE. Requires wireless telecommunications service providers to transfer the billing authority and rights to the wireless telephone number or numbers to the petitioner, if the petitioner is not the account holder, upon court order. (HB538 HD2)

RELATING TO MOTOR VEHICLE DRIVER LICENSING. Authorizes the issuance of limited purpose driver's licenses, provisional licenses, and instruction permits for individuals who are otherwise eligible for a license or permit but do not present proof of authorized presence in the United States.

DECISION MAKING TO FOLLOW
Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing. Testimony should indicate:
· Testifier's name with position/title and organization;
· The Committee(s) to which the comments are directed;
· The date and time of the hearing; and
· Measure number.
While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may be distributed to the Committee after the hearing.
Submit testimony in ONE of the following ways:

FAX: For testimony less than 5 pages in length, transmit to 808-586-6531 (Oahu) or 1-800-535-3859 (for Neighbor Islander without a computer to submit testimony through e-mail or the Web); or
WEB: For testimony less than 10MB in size, transmit from http://www.capitol.hawaii.gov/submittestimony.aspx.
Testimony submitted will be placed on the legislative website. This public posting of testimony on the website should be considered when including personal information in your testimony. Those wishing to provide oral testimony will be limited to two minutes.
