THE FOLLOWING MEASURES WERE PREVIOUSLY HEARD IN THEIR RESPECTIVE STANDING COMMITTEES:
RELATING TO PILOTAGE. Regulates the liability of port pilots. Exempts vessels under 300 gross tons from pilotage regulation. Requires the department of commerce and consumer affairs to report to the legislature on continuing education requirements, investigations to determine qualifications of pilots applying for license renewal and other matters relevant to licensure. Effective 7/1/2050. (SD1)

RELATING TO NEIGHBORHOOD BOARDS. Allows neighborhood board members to attend certain meetings under certain circumstances. Effective July 1, 2050. (SD1)

RELATING TO POLICE DEPARTMENTS. Repeals the privacy exemption within the Uniform Information Practices Act for county police department officers. (SD1)

RELATING TO MOTOR VEHICLE LICENSING. Requires that a driver's license issued to a person who is an unspecified years of age or older, at the time of issuance, shall expire on the licensee's unspecified birthday, or two years from the date of license issuance, whichever is later in time. Effective 7/1/2050. (SD1)

RELATING TO LAW ENFORCEMENT. Defines "person in custody" as used in the offense of sexual assault in the third degree to mean a person who is stopped by or under the control of a law enforcement officer for official purposes. (SD1)

RELATING TO PUBLIC SAFETY. Requires pretrial risk assessments, pretrial bail reports, and arraignments to be completed within five working days after an arrest. Obligates the intake service centers to interview lay sponsors within seven days of their identification and allows the court to order defendants released on bail, recognizance, or supervised release to report to lay sponsors for supervision. Prohibits judicial officers from denying bail absent a pretrial risk assessment score that reflects a high risk of flight or commission of a new criminal offense. Prohibits judicial officers from relying on a bail schedule or bail amount that would have been necessary to prevent release of a defendant during jail overcrowding. (SD1)

RELATING TO BACKGROUND CHECKS. Expand the authority of the department of health to conduct background checks to include criminal history record check, adult abuse perpetrator and child abuse record checks, and certified nurse aide registry record checks for persons seeking employment with the State or its contractors where the work involves direct client care and applicants and operators of healthcare facilities. RELATING TO ADVANCED PRACTICE REGISTERED NURSES. Clarifies the role of advanced practice registered nurses in sections of the Hawaii Revised Statutes relating to emergency hospital admission and involuntary hospitalization.

RELATING TO INSURANCE. Requires insurers who provide health care coverage to provide coverage for medically necessary health care services covered by a health insurance policy when provided by licensed naturopathic physicians acting within their scope of practice. Specifies that health care services provided by naturopathic physicians may be subject to certain limitations. Specifies that limitations shall not direct treatment in a manner that unfairly discriminates against the practice of naturopathic medicine. Permits insurers to require naturopathic physician services to be provided by a naturopathic physician under contract or covered as consistent with out-of-network provider reimbursement practices. Effective 07/01/2050. (SD1)

RELATING TO THE HAWAII COMMUNITY DEVELOPMENT AUTHORITY. Requires HCDA to schedule a public information meeting to present the developer's project proposal and requests for modifications or variances. Amends the deadline to intervene in a proceeding to accept a developer's proposal to twenty days after the public informational meeting on a developer's proposal. Requires developers to convene community meetings on proposed projects prior to submitting their application. Requires HCDA to make certain findings regarding the proposed project and its impacts in order to approve the proposed development. Requires developers to abide by all representations and commitments made in the permit application process. (SD1)

RELATING TO THE UNIFORM CONTROLLED SUBSTANCE ACT. Requires practitioners to register to use the electronic prescription accountability system in order to administer, prescribe, or dispense a controlled substance; requires all practitioners administering, prescribing, or dispensing a controlled substance in schedules II through IV to register with the electronic prescription accountability system with renewal of the controlled substance registration beginning January 1, 2016; requires all practitioners and practitioner delegates to request patient information from the central repository prior to administering, prescribing, or dispensing a controlled substance to a new patient and for any patient that is receiving chronic pain therapy beginning January 1, 2017, with a specific exception; provides pharmacist delegates and practitioner delegates with access to the electronic prescription accountability system; and in certain situations, expands access to investigative information in the electronic prescription accountability system to include law enforcement officers and investigative agents of regulatory agencies and various individuals. RELATING TO MOTOR VEHICLE DRIVER LICENSING. Creates a limited purpose driver's license, limited purpose provisional driver's license, and limited purpose instruction permit. Provides that limited purpose driver's licenses, limited purpose provisional driver's licenses, and limited purpose instruction permits shall not be acceptable for federal identification and voting purposes. Requires satisfactory proof of identity and Hawaii residency. Effective 1/1/2016. (SD1)
