RELATING TO EMPLOYMENT AGREEMENTS. Prohibits noncompete agreements and restrictive covenants in employment contracts, post-employment contracts, or separation agreements that forbid post-employment competition of licensed physicians.

RELATING TO HEALTH. Establishes licensure requirement for durable medical equipment suppliers participating in the nationwide competitive bidding program through an annual inspection by the office of health care assurance. Appropriates funds from the office of health care assurance special fund to administer the durable medical equipment licensing program.

RELATING TO HEALTH. Increases the minimum age for persons who may purchase tobacco products or electronic smoking devices from eighteen to twenty-one years of age. Amends the definition of "electronic smoking device" as used in section 709-908, Hawaii Revised States. Defines "tobacco products".

RELATING TO ELECTRONIC SMOKING DEVICES. Establishes an excise tax on electronic smoking devices equal to 30 per cent of the wholesale price of each electronic smoking device kit, electronic smoking device nicotine cartridge, or electronic smoking device nicotine refill sold, used, or possessed by a wholesaler or dealer on or after January 1, 2016. Allocates taxes collected to the Hawaii tobacco prevention and control trust fund, to be used for smoking cessation programs in Hawaii, with an emphasis on teen smoking prevention and cessation programs. Amends Hawaii's anti-smoking statute to prohibit the use of electronic smoking devices in places open to the public and other specified locations. Prohibits the sale or furnishing of electronic smoking devices to a minor under twenty-one years of age. Prohibits minors under twenty-one years of age from purchasing electronic smoking devices.

RELATING TO PSYCHOLOGISTS. Amends the continuing education requirement for psychologists to include at least three credit hours of ethics training and at least two credit hours of domestic violence training.

RELATING TO ADVANCED PRACTICE REGISTERED NURSES. Clarifies the role of advanced practice registered nurses in sections of the Hawaii Revised Statutes relating to emergency hospital admission and involuntary hospitalization.

RELATING TO THE UNIFORM CONTROLLED SUBSTANCE ACT. Requires practitioners to register to use the electronic prescription accountability system in order to administer, prescribe, or dispense a controlled substance; requires all practitioners prescribing or dispensing a controlled substance in schedules II through IV to use the electronic prescription accountability system beginning January 1, 2016; requires all practitioners and practitioner delegates to request patient information from the central repository prior to prescribing or dispensing a controlled substance to a new patient and for any patient that is receiving chronic pain therapy beginning January 1, 2017; provides pharmacist delegates and practitioner delegates with access to the electronic prescription accountability system; and in certain situations, expands access to investigative information in the electronic prescription accountability system to include law enforcement officers and investigative agents of regulatory agencies and various individuals.

RELATING TO HEALTH. Requires entities that offer or renew health plans on or after January 1, 2017, to make available a complete and updated formulary to enrollees, potential enrollees, and providers.

RELATING TO LATEX. Prohibits the use of latex gloves in dental health facilities, health care facilities, by personnel providing ambulance services or emergency medical services pursuant to the state comprehensive emergency medical services system, and in food establishments.

RELATING TO NATUROPATHIC PHYSICIANS. Requires insurers, mutual benefit societies, fraternal benefit societies, and health maintenance organizations to provide coverage for health care services provided by a naturopathic physician.
