RELATING TO BEHAVIOR SUPPORT REVIEW COMMITTEE FOR PERSONS WITH DEVELOPMENTAL OR INTELLECTUAL DISABILITIES. Authorizes the department of health to establish a behavior support review process to conduct multidisciplinary reviews of the restraint or seclusion of persons with developmental or intellectual disabilities. Exempts those who participate in the reviews from liability. (SD2)

RELATING TO BACKGROUND CHECKS. Expand the authority of the department of health to conduct background checks to include criminal history record checks, sex offender registry record checks, adult abuse perpetrator and child abuse and neglect record checks, and certified nurse aide registry record checks for persons seeking employment with the State or its contractors where the work involves direct client care and volunteers, applicants, and operators of healthcare facilities. RELATING TO THE HAWAII STATE HOSPITAL. Requires the department of health and Hawaii state hospital to consider certain recommendations made by the senate special investigative committee on the Hawaii state hospital and submit a written report to the legislature of its status of implementing certain recommendations prior to the regular sessions of 2016 and 2017. RELATING TO MENTAL HEALTH TREATMENT. Removes the ten-day time limit for setting a hearing date on a petition for assisted community treatment. Allows for notice of continuation hearings to the subject to be served via the public defender. Allows the court to appoint a guardian ad litem when the subject of a petition fails to appear at a hearing. Specifies provisions governing the appointment of a public defender or other court-appointed counsel. Removes provisions allowing the court to order a subject to be examined by a licensed psychiatrist. Requires treating providers to provide the department of health information related to MH-1s and hospitalization of persons who are under an order to treat by September 30 of each year. RELATING TO ADVANCED PRACTICE REGISTERED NURSES. Clarifies the role of advanced practice registered nurses in sections of the Hawaii Revised Statutes relating to emergency hospital admission and involuntary hospitalization.

RELATING TO INSURANCE. Requires insurers who provide health care coverage to provide coverage for medically necessary health care services covered by a health insurance policy when provided by licensed naturopathic physicians acting within their scope of practice. Specifies that health care services provided by naturopathic physicians may be subject to certain limitations. Specifies that limitations shall not direct treatment in a manner that unfairly discriminates against the practice of naturopathic medicine. Permits insurers to require naturopathic physician services to be provided by a naturopathic physician under contract or covered as consistent with out-of-network provider reimbursement practices. RELATING TO AUTISM SPECTRUM DISORDERS. Requires health insurers, mutual benefit societies, and health maintenance organizations to provide coverage for autism diagnosis and treatment. Effective 7/1/2050. (SD1)

RELATING TO LICENSING. Establishing the behavior analyst program within the department of commerce and consumer affairs. Establishes licensing requirements for behavior analysts. Appropriates funds for the implementation of the behavior analyst program. Effective 7/1/2053. (SD3)

RELATING TO HEALTH. Requires the department of education to provide care to students with diabetes pursuant to a student's diabetes medical management plan. Makes an appropriation to DOE and DOH. Effective 7/1/2050. (SD2)

RELATING TO LATEX. Prohibits the use of latex gloves in dental health facilities, health care facilities, by personnel providing ambulance services or emergency medical services pursuant to the state comprehensive emergency medical services system, and in food establishments. RELATING TO HEALTH. Establishes the narcotics advisory committee to recommend acceptable topics and curriculum for the continuing medical education program. Establishes requirements for a mandatory continuing medical education program for prescribing practitioners that prescribe narcotic drugs. (SD2)

RELATING TO THE UNIFORM CONTROLLED SUBSTANCE ACT. Requires practitioners to register to use the electronic prescription accountability system in order to administer, prescribe, or dispense a controlled substance; requires all practitioners administering, prescribing, or dispensing a controlled substance in schedules II through IV to register with the electronic prescription accountability system with renewal of the controlled substance registration beginning January 1, 2016; requires all practitioners and practitioner delegates to request patient information from the central repository prior to the practitioner administering, prescribing, or dispensing a controlled substance to a new patient and for any patient that is receiving chronic opioid therapy beginning January 1, 2017, with a specific exception; provides pharmacist delegates and practitioner delegates with access to the electronic prescription accountability system; and in certain situations, expands access to investigative information in the electronic prescription accountability system to include law enforcement officers and investigative agents of regulatory agencies and various individuals. Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing. Testimony should indicate:
· Testifier's name with position/title and organization;
· The Committee(s) to which the comments are directed;
· The date and time of the hearing; and
· Measure number.
While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may be distributed to the Committee after the hearing.
