RELATING TO COURT ORDERS TO PROVIDE MEDICAL TREATMENT FOR INMATES AND DETAINEES IN CORRECTIONAL FACILITIES. Provides for the filing of a petition for involuntary medical treatment in either the district or circuit court; allows for a declaration to be filed with the petition as an alternative to an affidavit; expands the court's ability to continue the hearing on the petition for good cause; gives the court more flexibility in deciding when to appoint a guardian ad litem or temporary guardian; changes the time within which a person must be examined from two days to five days prior to filing of the petition; amends the list of persons who must be notified of the petition; and clarifies the effective expiration date of the order for persons who return to custody after release.

RELATING TO PAROLE. Specifies that funds for discharged persons be subject to legislative appropriation. Clarifies circumstances under which the paroling authority may grant early discharges. Provides discretion to the paroling authority with respect to initial pardon consideration as it relates to paroled prisoners. Effective 07/01/2050.

RELATING TO PUBLIC SAFETY. Establishes civilian community teams. Makes an appropriation to assemble 25 civilian community teams and hire a coordinator to help establish, train, and assist the teams. Effective July 1, 2050.

RELATING TO THE EMPLOYEES' RETIREMENT SYSTEM. Authorize a court to decree the forfeiture of all or any portion of the Employee Retirement System benefits to which a member, former member, or retirant of state or county employment would otherwise have been entitled if the member, former member, or retirant is convicted of a felony that the court finds to be related to the employment of the member, former member, or retirant. Requires the employees' retirement system to comply with the court.

MAKING EMERGENCY APPROPRIATIONS FOR COLLECTIVE BARGAINING COST ITEMS. Provides fund authorizations and appropriations for all collective bargaining cost items for salary increases and other wage related costs in the arbitrated settlement for bargaining unit (11) and its excluded counterparts for fiscal biennium 2013-2015.

RELATING TO COLLECTIVE BARGAINING. Prohibits parties in arbitration from including in their final positions any proposals that were not previously submitted in writing before impasse and about which an impasse in collective bargaining has not been reached. Requires the arbitration panel to decide whether final positions comply with all requirements and which proposals may be considered for inclusion in the final agreement. Effective July 1, 2050.

RELATING TO WAGES AND HOURS ON PUBLIC WORKS. Increases the penalties imposed on a contractor who interferes with or delays an investigation to determine compliance with wage and hour laws of employees on public works. Specifies that a general contractor is secondarily liable for payment of back wages and penalties. Increases the suspension period from three to five years for a third violation. Clarifies the effective date of suspension. Specifies that suspension for falsification of records or delay or interference with an investigation is immediate. Specifies who the director of labor and industrial relations must notify of any suspension order. Effective July 1, 2050.

RELATING TO PUBLIC WORKS. Establishes the Wage and Hour for Public Works Projects Special Fund to fund enforcement of wage and hour laws for public works projects. Requires state departments, except DOT Airports Division, to transfer a percentage of CIP appropriations to the special fund. Establishes and funds two additional labor law enforcement specialist IV positions in DLIR. Effective July 1, 2114.

RELATING TO PUBLIC EMPLOYMENT. Makes hiring of technical and professional staff in accordance with civil service laws by the state historic preservation division mandatory. Sunsets civil service exemptions for positions created after July 1, 2014, three years after enactment unless affirmatively extended. Effective July 1, 2114.

RELATING TO INSURANCE CLAIMS. Limits the reimbursement payments of prescription medications, including relabeled, repackaged, or compounded prescription medications, in workers' compensation claims. Requires motor vehicle insurance benefits to automatically adopt the prescription drug pricing protections associated with the workers' compensation supplemental medical fee schedule, unless otherwise modified by the Insurance Commissioner through rulemaking. Effective July 1, 2050.

DECISION MAKING TO FOLLOW
Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing. Testimony should indicate:
· Testifier's name with position/title and organization;
· The Committee(s) to which the comments are directed;
· The date and time of the hearing; and
· Measure number.
While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may be distributed to the Committee after the hearing.

Testimony submitted will be placed on the legislative website after the hearing adjourns. This public posting of testimony on the website should be considered when including personal information in your testimony.
