RELATING TO INSURANCE. Adopts revisions to the National Association of Insurance Commissioners' model laws on Credit for Reinsurance Model Act (Part I), Standard Valuation Law (Part II), Standard Nonforfeiture for Life Insurance (Part III), and Insurance Holding Company System Regulatory Act (Part II). Takes effect on 7/1/2050. Part I takes effect on 1/1/2051. (SD2)

RELATING TO PROCUREMENT. Prohibits any contract that is entered into by any governmental body with a person licensed under chapter 464, Hawaii Revised Statutes, from requiring the contractor to defend the governmental body from claims arising out of the contractor's performance under the contract. Provides that the requirement for persons licensed under chapter 444, Hawaii Revised Statutes, to defend a governmental body from claims arising out of the contractor's performance under, or any subcontractor's performance pursuant to, the contract shall not extend beyond the owner's final acceptance of the project and the contractor's warranty period up to a minimum of one year after final acceptance. RELATING TO THE PUBLIC UTILITIES COMMISSION. Specifies that the public utilities commission is an autonomous agency of the State to be transferred from the department of budget and finance and assigned, for administrative purposes only, to the department of commerce and consumer affairs. Increases the compensation of the chair and commissioners of the public utilities commission. Clarifies the public utilities commission's authority concerning standard administrative practices, including operational expenditures and the hiring of personnel. Enables the chair of the public utilities commission to appoint, employ, and dismiss an executive officer to assist with managing the operations of the commission. Specifies that the executive director of the division of consumer advocacy shall be the consumer advocate in hearings before the public utilities commission. Appropriates funds for the transfer of the public utilities commission and for the hiring of an executive officer within the public utilities commission. Effective 07/01/2050. (SD1)

RELATING TO CONTINUING EDUCATION FOR MARRIAGE AND FAMILY THERAPISTS. Requires licensed marriage and family therapists to complete a minimum of forty-five hours of continuing education courses, including six hours in ethic courses, during each licensing renewal period, for the period beginning 1/1/2017, and thereafter. Effective 7/1/2050. (SD1)

RELATING TO TIME SHARES. Eliminates requirement that a manager of a foreign time share plan register in Hawaii as a time share plan manager. Requires the disclosure statement for an offering of a time share plan to disclose that the manager of a foreign time share plan is not registered under Hawaii's time share law. Recognizes that an association of time share owners may be any kind of nonprofit or not-for-profit entity. Makes housekeeping amendments. (SD1)

RELATING TO CONDOMINIUM ASSOCIATIONS. Proposed HD1: Clarifies that a condominium association's lien is subordinate to real property taxes, rather than to all taxes. Clarifies that a condominium association may assess unpaid uncommon fees against a purchaser, in addition to a mortgagee, who purchases a delinquent unit in a judicial or nonjudicial power of sale foreclosure. Clarifies that condominium association boards may only fill board vacancies to serve until the next annual or duly noticed meeting. Effective July 1, 2050

RELATING TO ASSISTING UNLICENSED CONTRACTORS. Clarifies that a contractor licensee who aids and abets an unlicensed contractor may be subject to additional discipline by the contractors license board.

RELATING TO CERTIFICATION OF GAS TANKLESS WATER HEATERS. Proposed HD1: Requires certification of gas tankless and non-gas tankless on-demand water heater from a North American certification organization, which shall include the Canadian Standards Association International; the Air-Conditioning, Heating, and Refrigeration Institute; Gas Appliance Manufacturers Association Certification Program, which list certified products and models. Effective July 1, 2014

RELATING TO ONLINE PROTECTION OF INDIVIDUAL RIGHTS. Applies provisions in chapter 481B, part II, relating to civil liability for bad faith registration of a domain name, determining bad faith intent, and good faith exception to individuals and business entities. Effective 07/01/2050. (SD1)

RELATING TO THE PROTECTION OF CHARITABLE ASSETS. Grants oversight authority to the attorney general over charitable assets regardless of the form in which they are held. Authorizes the attorney general to enforce the application of the charitable asset to prevent or remedy the misapplication, diversion, waste, or breach of duty in management of a charitable asset. Effective 07/01/2050. (SD1)
