RELATING TO THE HAWAIIAN HOMES COMMISSION.

Allows the Hawaiian homes commission or the department of Hawaiian home lands to retain independent legal counsel as needed.  Authorizes the Hawaiian homes commission and the department of Hawaiian home lands to use the services of the attorney general as needed and when the interests of the State, Hawaiian homes commission, and department of Hawaiian home lands are aligned.  Provides that funds paid to independent legal counsel shall be paid by the State.  Takes effect 7/1/2050.  (SD1)

RELATING TO TRAINING.

Requires OHA to either administer or approve a third party to administer a mandatory training course in native Hawaiian and Hawaiian matters to members of certain state councils, boards, and commissions.  Requires those members to take the course within one year of their respective appointments.  Effective 07/01/2050.  (SD2)

RELATING TO BREASTFEEDING IN THE WORKPLACE.

Requires certain employers to provide reasonable time and private location for breastfeeding employees to express breast milk.  Requires covered employers to post a notice.  Establishes a civil fine of an unspecified amount.  Effective July 1, 2113.  (SB532 HD1)

Status

RELATING TO COLLECTION OF RESTITUTION FOR CRIME VICTIMS.

Creates standards and procedures for income-withholding, for purposes of enforcing restitution orders.  Amends the definition of "debt" relating to the recovery of money owed to the State to include court-ordered restitution subject to civil enforcement.  Provides priority of income withholding orders.  Removes court's authority to revoke restitution once ordered.  Extends victims' access to adult probation records, to include access to payment compliance records, for purposes of enforcing restitution orders.  Requires that any bail posted by a defendant be applied toward payment of any court-ordered restitution in the same case.  Makes an unspecified appropriation to the judiciary for the purpose of enhancing restitution collection.  (SD2)

RELATING TO FIREARMS.

Requires county police departments under certain conditions to fingerprint, photograph, and perform background checks on individuals who wish to register a firearm that was procured out-of-state.  Authorizes the police departments to assess a fee for conducting a fingerprint check and specifies the amount of the fee.  Extends the time period for registering a firearm procured out-of-state, for consistency with the time period for registering firearms obtained in or imported into the State.  Appropriates funds for county implementation.  Effective July 1, 2013.  (SB69 HD1)

RELATING TO CHILDREN.

Appropriates funds to the judiciary for the Honolulu zero to three court to fund the coordinator's transportation to visit children and parents, emergency housing assistance, a secure opening at a residential drug and alcohol facility that will accommodate a mother and child, development and implementation of an incentive program similar to the successful model utilized in family drug court, training and professional development of court team members and community partners, and creation and utilization of an enhanced visitation and parenting coaching site in leeward Oahu.  Effective 7/01/2050.  (SD2)

RELATING TO THE KAHOOLAWE ISLAND RESERVE.

Clarifies the offenses for which property is subject to forfeiture under chapter 6K, Hawaii Revised Statutes, relating to the Kaho‘olawe island reserve, including any activity prohibited by rules of the island reserve and any violation of rules regulating fishing in waters within the island reserve, except by persons or vessels within one nautical mile of the boundaries of the island reserve.  Clarifies that property seized in accordance with section 199-7, Hawaii Revised Statutes, may be forfeited and any natural resource seized may be disposed of as provided by law.  Effective 07/01/50.  (SD2)

RELATING TO ANIMAL CRUELTY.

Amends offenses of causing injury or death to a service dog and intentional interference with the use of a service dog to include law enforcement animals.  Adds a definition for "law enforcement animal to the Penal Code".  (SB635 HD1)

RELATING TO HIGHWAY SAFETY.

Establishes a three-year pilot photo red light imaging detector system program.  Authorizes counties to administer the program.  Makes other amendments regarding highway safety.  Effective July 1, 2150.  Repeals July 1, 2016.  (SB693 HD1)
