RELATING TO ADVANCED PRACTICE REGISTERED NURSES.

Amends section 457-8.5(a), Hawaii Revised Statutes, by recognizing the National Council of State Boards of Nursing's advanced practice registered nurse consensus model and clarifies language relating to advanced practice registered nurse educational requirements consistent with that consensus model.

Status

RELATING TO NURSING.

Requires the professional and vocational licensing division of the department of commerce and consumer affairs and the state board of nursing to collaborate with the center for nursing to enable the center to obtain nursing-related data.  Requires the professional and vocational licensing division to provide the center for nursing with various information through a memorandum of understanding and requires completion of a center for nursing survey as part of the license renewal requirements under chapter 457, Hawaii Revised Statutes.

Status

RELATING TO DENTAL HEALTH.

Requires the director of health to participate in the national oral health surveillance system.  Permits dental hygienists to apply preventative sealants in a school-based dental sealant program.  Requires the department of health to establish and administer a school-based dental sealant program in a high-need demonstration school and report to the legislature about the department's efforts to prioritize prevention of tooth decay.  Appropriates funds to establish and administer a school-based dental sealant program in a high-need demonstration school, including plans to implement the program on a statewide level.

RELATING TO ELECTRONIC PRESCRIPTIONS.

Amends the Uniform Controlled Substances Act in Chapter 329, Hawaii Revised Statutes, by adding definitions consistent with federal law, clarifying the conditions for electronic transmittal of prescriptions, and adding and clarifying violations of prohibited acts.

Makes remote dispensing machines by a licensed pharmacy or pharmacist and its operations permanent.

RELATING TO FORENSIC MENTAL HEALTH.

Amends the penal code provisions that affect adult mental health and the Hawaii State Hospital census.

RELATING TO HEALTH.

Adds definitions for "qualifying diagnosis" and "severe and persistent mental illness."  Requires the adult mental health division of the department of health to provide services to people with a qualifying diagnosis, including services that are not covered by an insurance policy held by or for the benefit of the individual who seeks services.  Makes an appropriation for mental health services for adults, adolescents, and children, that have been eliminated or reduced in the past two years.  Makes an appropriation for substance abuse treatment and mental health support services for individuals who are homeless or at risk of becoming homeless.

RELATING TO MENTAL HEALTH TREATMENT.

Establishes an assisted community treatment program in lieu of the involuntary outpatient treatment program.  Replaces the term "involuntary outpatient treatment" with "assisted community treatment".  Makes several amendments regarding involuntary outpatient treatment procedures.

RELATING TO NATIVE HAWAIIANS.

Establishes a $1 fee for certified copies of birth, marriage, divorce, or death certificates when used to verify an individual's Native Hawaiian ancestry for certain purposes.  Requires Director of Health to deposit fee into the State's general fund.  (HB251 HD1)

RELATING TO OBESITY PREVENTION.

Establishes the Hawaii Interagency Obesity Prevention Council; Appropriates funds from the Children's Health Promotion fund for programs related to obesity prevention and related chronic diseases.

RELATING TO DIABETES.

Requires DOH, in collaboration with DHS, to develop departmental plans to reduce the incidence of diabetes in the State and report to the legislature annually on the effectiveness of those plans.

RELATING TO HEALTH.

Requires schools with enrolled students with diabetes to provide diabetes care by a nurse or trained diabetes care personnel during school hours and at all school-related functions.  Permits students with diabetes to administer their own diabetes care.

Status

RELATING TO THE HAWAII HEALTH SYSTEMS CORPORATION.

Authorizes the HHSC to obtain a loan under the EB-5 program to fund a corporation project with the governor's approval.  Requires a legislative appropriation to expend loan proceeds.  Requires the corporation to include in its annual budget an amount to repay the EB-5 loan.  Effective July 1, 2050.  (HB576 HD1)

RELATING TO PHARMACY BENEFITS MANAGERS.

Prohibits a pharmacy benefits manager from using a patient's prescription drug benefits claim information to market to that patient the services of a preferred pharmacy network that is owned by the pharmacy benefits manager.

RELATING TO CONTROLLED SUBSTANCES.

Repeals mail order pharmacy exemption from controlled substances act.

RELATING TO PRESCRIPTION DRUGS.

Allows beneficiaries of prescription drug benefits providers to opt out of the requirement to purchase prescription drugs from a mail-order pharmacy and may alternatively purchase prescription drugs from a retail pharmacy.

RELATING TO MEDICAL MARIJUANA.

Amends aspects of the Medical Use of Marijuana regime: defining adequate supply, confidentiality of growing sites, certifying physician requirements, confidentiality of patient's condition, caregiver to patient ratio, transportation of medical marijuana, qualifying visitors, and registration requirements.  Effective July 1, 2013.

RELATING TO SALES OF ELECTRONIC SMOKING DEVICES TO PERSONS UNDER 18 YEARS OF AGE.

Adds electronic smoking devices to tobacco as products that are unlawful to sell to or be purchased by persons under eighteen years of age; and requires the additional listing of electronic smoking devices to sales prohibition signage.

Status

RELATING TO HEALTH.

Requires cigarettes and tobacco products to be stored for sale behind a counter.  Requires advertisements that promote or encourage the purchase or use of cigarettes or tobacco products to be placed twenty-five feet away from children's products, toys, cookies, candy, ice cream, gum, or snacks.  Requires advertisements that promote or encourage the purchase or use of cigarettes or tobacco products to be placed four feet off the floor.  Permits exceptions for retail tobacco stores, bars, or establishments where the minimum age for admission is eighteen.  Includes electronic cigarettes under the definition of tobacco products.

RELATING TO TOBACCO.

Prohibits any minor under the age of eighteen from possessing or smoking tobacco products.  Takes effect 1/1/2014.

RELATING TO LANGUAGE ACCESS.

Establishes and provides appropriations for a statewide language access resource center and multilingual website pilot project to be administered by the office of language access.

RELATING TO PEDIATRIC DENTAL HEALTH COVERAGE.

Amends definition of "qualified patient" to include pediatric dental benefits as provided under the federal Affordable Care Act.
