     Your Committee on Finance, to which was referred S.B. No. 1171, S.D. 1, H.D. 1, entitled:




begs leave to report as follows:


     The purpose of this measure is to protect Hawaii's historical and cultural heritage while providing flexibility in the review of construction projects by, among other things:


(1)  Authorizing the phased review of projects by the Department of Land and Natural Resources' State Historic Preservation Division under certain conditions to ensure consistency between state and federal law; and


(2)  Deleting language that provided the Governor with the option to request the Hawaii Advisory Council on Historical Preservation to report in cases where an agency, officer, or other person is dissatisfied with a decision of the Hawaii Historic Places Review Board.


     The Department of Transportation; Department of Land and Natural Resources; Department of Agriculture; Department of Business, Economic Development, and Tourism; Office of Planning; Department of Accounting and General Services; Department of Hawaiian Home Lands; Department of Education; Department of Design and Construction of the City and County of Honolulu; Department of Transportation Services of the City and County of Honolulu; Building Industry Association of Hawaii; Hawai‘i Construction Alliance; Hawaii Laborers Employers Cooperation and Education Trust; Hawaii Laborers' Union; Hawaii Regional Council of Carpenters; Pacific Resource Partnership; BKA Builders Inc.; Universal Construction, Inc.; General Contractors Association of Hawaii; Kapolei Chamber of Commerce; Hawaii Island Contractors' Association; and several concerned individuals supported this measure.  The Office of Hawaiian Affairs; ‘Īlio‘ulaokalani Coalition; KAHEA: The Hawaiian-Environmental Alliance; Society for Hawaiian Archaeology; Ko‘olau Foundation; Historic Hawai‘i Foundation; Sierra Club, Hawai‘i Chapter; Hui Mālama I Nā Kūpuna O Hawai‘i Nei; Ko‘olaupoko Hawaiian Civic Club; Makawalu; a councilmember of the Kauai County Council; and numerous concerned individuals opposed this measure.  The Land Use Research Foundation of Hawaii, Native Hawaiian Legal Corporation, and several concerned individuals provided comments.


     Your Committee has amended this measure by:


(1)  Changing its effective date from January 1, 2050, to upon its approval; and


(2)  Making technical, nonsubstantive amendments for clarity, consistency, and style.


     As affirmed by the record of votes of the members of your Committee on Finance that is attached to this report, your Committee is in accord with the intent and purpose of S.B. No. 1171, S.D. 1, H.D. 1, as amended herein, and recommends that it pass Third Reading in the form attached hereto as S.B. No. 1171, S.D. 1, H.D. 2.
