A BILL FOR AN ACT

 

 

RELATING TO WANTON WASTE.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 183D, Hawaii Revised Statutes, is amended by adding a new section to part I to be appropriately designated and to read as follows:

     "§183D-     Wanton waste; penalties.  (a)  No person shall wantonly waste the edible portion of a game bird or game mammal.

     (b)  Any portion of the game bird or game mammal not harvested shall be properly disposed of.  Proper disposal in the field shall include but not be limited to the cover or burial of all non-edible portions of the game, including any offal, bones, hide, or other waste resulting from the gutting and dressing of a game bird or game mammal.

     (c)  Any person who violates this section shall be guilty of a misdemeanor and shall:

     (1)  Be fined not more than $250 for the first offense;

     (2)  Be fined not more than $500 for the second offense;

     (3)  Be fined not more than $1,000 for the third offense; and

     (4)  Be fined not more than $1,000 and serve a mandatory minimum jail sentence of seven days for all subsequent offenses.

     (d)  Each game bird or game mammal wantonly wasted shall be independently subject to a separate fine.  Each hunting expedition shall constitute a separate offense.

     (e)  Half of all proceeds collected by the department for violations of this section shall be deposited to the credit of the wildlife revolving fund established pursuant to section 183D-10.5 and the remainder shall be deposited to the credit of the state general fund."

     SECTION 2.  Section 183D-1, Hawaii Revised Statutes, is amended by adding two new definitions to be appropriately inserted and to read as follows:

     ""Edible portion" means all four quarters of a game mammal above the knee or hock, including the loin and backstrap, and the breast meat of a game bird.

     "Wantonly waste" means the intentional leaving or waste of any game bird or game mammal suitable for food by:

     (1)  Abandoning the carcass or any portion of the carcass suitable for food in the field;

     (2)  Detaching or removing only the head, hide, antlers, tusks, or teeth or any or all of these parts from the carcass of a game mammal, or only the feathers of a carcass of a game bird; or

     (3)  Transporting, hanging, or storing the carcass in a manner that renders it unfit for human consumption."

     SECTION 3.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.

     SECTION 4.  New statutory material is underscored.

     SECTION 5.  This Act shall take effect upon its approval.
