RELATING TO THE RESIDENTIAL LANDLORD-TENANT CODE.

Prohibits landlords from recovering possession of a dwelling unit from tenants if habitability of the premises is significantly impaired.  Sets a tenant's liability for rent if habitability of the premises is significantly impaired.  Provides remedies for retaliatory evictions.  Effective 7/1/2124.  (SD1)

RELATING TO RENTAL DISCRIMINATION.

Prohibits discrimination, including in advertisements for available real property, based on participation in a housing assistance program, or requirements related to participation in housing assistance programs, in rental transactions and requirements.  Establishes the landlord incentive program special fund to reimburse land owners who participate in the section 8 housing choice voucher program for repair costs of tenant-caused property damage when the repair costs exceed the tenant's security deposit.  Makes an appropriation.  (SD1)

RELATING TO SEX TRAFFICKING.

Includes coercion as a means of committing the offense of sex trafficking.  Removes the criminal statute of limitations for sex trafficking and promoting prostitution.  Designates solicitation of a minor for prostitution as a form of sex trafficking.  Specifies that sex trafficking of a minor is a strict liability offense.  Repeals the offense of solicitation of a minor for prostitution.  Effective 5/1/2024.  (SD1)

RELATING TO HISTORIC PRESERVATION REVIEWS.

Authorizes the Department of Land and Natural Resources, in consultation with the Office of Hawaiian Affairs, to delegate to the impacted counties the responsibility for certain historic preservation project reviews, provided that certain requirements are met.  Allows the Department of Land and Natural Resources to establish a program to certify third-party individuals and organizations to review documents for completeness and compliance prior to submission of those documents to the Department; provided that certain requirements are met.  (SD1)

RELATING TO USED MOTOR VEHICLE PARTS.

Requires licensed used motor vehicle part dealers to obtain a written statement by a seller of a catalytic converter that the seller has the lawful right to sell and dispose of the catalytic converter.  Requires a seller of a catalytic converter to present a receipt or notarized declaration regarding the catalytic converter.  Prohibits a licensed used motor vehicle part dealer from purchasing a catalytic converter with no receipt or notarized declaration and to report the attempted sale to the police.  Establishes the offense of theft of catalytic converter as a class C felony.  (SD1)

Prohibits holdover board members of the Hawaii Tourism Authority from holding office beyond the commencement of the next legislative session following the expiration of the member's term of office.  (SD1)

RELATING TO ROOFING CONTRACTORS.

Prohibits roofing contractors from offering to pay, in any monetary form, an insured's insurance deductible as an incentive to encourage the insured to hire the contractor.  Allows insureds to rescind contracts with roofing contractors within five business days of receiving notification from an insurer that all or any part of a claim or contract is not a covered loss under the insured's insurance policy.  (SD1)

RELATING TO THE FESTIVAL OF PACIFIC ARTS.

Extends the date on which the temporary commission on the thirteenth festival of pacific arts shall cease to exist to August 31, 2025.  Permits less than a quorum of commission members to discuss matters relating to official board business outside a commission meeting as a permitted interaction under part I of chapter 92, Hawaii Revised Statutes, to enable them to perform their duties faithfully, provided that the commission holds a meeting at least once a month and discusses the progress of the permitted interaction matter at the next meeting.  (SD1)

Repeals the authorization for the governor to negotiate with any person for the development or expansion of private correctional facilities.  Prohibits the establishment of private correctional facilities in the State.

RELATING TO AFFORDABLE HOUSING.

Temporarily exempts affordable housing projects from specific state and county fees and exactions related to discretionary approval or ministerial permitting, except application fees; provided that the units are exclusively for qualified residents who are owner/renter occupants and own no other real property.  Sunsets on 6/30/2027.  (SD1)

RELATING TO COVERED OFFENDER REGISTRATION.

Repeals provision that allows persons designated as covered offenders in another state or jurisdiction to petition the Attorney General for termination of registration requirements upon demonstrating that the out of state convictions are not covered offenses in the State of Hawaii. Requires certain long term visitors to Hawaii with out-of-state convictions to register.  Clarifies how persons required to register can petition to terminate registration.  (SD1)

RELATING TO THE VENDING FACILITIES PROGRAM.

Establishes a two-year vendor facilities pilot program task force for vendors with serious mental illness within the department of health.  Requires the vendor facilities pilot program task force submit an annual report to the Governor and the Legislature not later than twenty days prior to the convening of the 2022 through 2023 regular sessions.  Takes effect on 5/1/2029.  (SD1)

      Status & Testimony

RELATING TO THE MODERNIZATION OF CRIMINAL JUSTICE.

Defines serious crime as murder or attempted murder in the first degree or class A felony, or a call B or C felony involving violence of threat of violence.  Allows the court to determine if bail may be denied where the charge is for a serious crime. Requires the judicial council to appoint a committee to review and recommend changes to the Hawaii penal code.  Takes effect 7/1/25.  (SD1)
