MAKING AN EMERGENCY APPROPRIATION TO THE DEPARTMENT OF HEALTH FOR THE EMERGENCY MEDICAL SERVICES AND INJURY PREVENTION SYSTEM BRANCH.

Makes an emergency appropriation to provide funds for the state comprehensive emergency medical system for expenses related to collective bargaining and other current expenses.  Effective upon approval.

RELATING TO PANDEMIC RESPONSE.

Authorizes use of funds appropriated from the emergency and budget reserve fund, from the amounts received by the State from the Coronavirus Aid, Relief, and Economic Security Act (CARES) Act, for the purchase and distribution of personal protective equipment and industrial hygiene products to state departments and attached agencies.  Effective retroactive to 7/1/2020.

Requires the department of health to establish a reorganization pilot project to reorganize the department of health behavioral health services administration.

Increases the cigarette and tobacco tax on cigarettes and little cigars by five cents beginning July 1, 2021.  Allocates excise tax revenue generated at the increased rate to specified health improvement purposes beginning July 1, 2021.

      Status & Testimony

RELATING TO THE TRANSITION OF THE OAHU REGIONAL HEALTH CARE SYSTEM FROM THE HAWAII HEALTH SYSTEMS CORPORATION INTO THE DEPARTMENT OF HEALTH.

Commences the transfer of the Oahu regional health care system in its entirety from the Hawaii health systems corporation to the department of health, beginning with the transfer of the Oahu regional health care system's budget and position count into the department of health.  Enables the Oahu regional health care system, department of health, Hawaii health systems corporation, and other state agencies to manage and implement the processes required to effectuate the completion of such transition.  Part II takes effect on 6/30/2022.

RELATING TO THE UNIFORM CONTROLLED SUBSTANCES ACT.

Removes cannabidiol drugs that have been approved by the United States Food and Drug Administration from the list of Schedule V substances for consistency with federal laws.

RELATING TO POOLS.

Defines "swimming pool" for the purposes of administrative rules to mean impervious, artificial bodies of water used for swimming, diving, or recreational bathing or therapy.

RELATING TO EMERGENCY POWERS.

Authorizes the governor to ensure the continued operation of medical facilities during times of health or pandemic emergencies.  Authorizes hospitals to suspend elective surgeries in order to address bed capacity during the period of emergency.

RELATING TO MASK AND QUARANTINE VIOLATIONS.

Limits first offense violations of a governor's emergency proclamation requiring wearing cloth face coverings to a fine of not more than $500.  Limits first offense violations of a governor's emergency proclamation requiring persons traveling from out of state to quarantine to a fine of not more than $500, except for those violators who post media of themselves violating the governor's order on social media or who travel to the State with symptoms or a positive test result for COVID-19.
