RELATING TO EDUCATION.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 2. Chapter 302A, Hawaii Revised Statutes, is amended by adding a new section to subpart C of part II to be appropriately designated and to read as follows:

"302A-    Ocean safety and stewardship education. (a) The department shall establish and administer an ocean safety and stewardship education program to be conducted at each elementary public school or a beach or another appropriate location for students in the fourth grade; provided that the department may provide an opt-out process for elementary public schools that have other comparable programs or conduct water safety training at a different grade level.

(b) The department may consult or contract with private organizations or instructors for the purposes of this section."

SECTION 3. Within one hundred eighty days of the effective date of this Act, the department of education shall implement the ocean safety and stewardship education program as required by section 2 of this Act.

SECTION 4. New statutory material is underscored.

SECTION 5. This Act shall take effect on January 1, 2050.
