A BILL FOR AN ACT

 

 

RELATING TO FELONIES.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Section 711-1112, Hawaii Revised Statutes, is amended to read as follows:

     "[[]§711-1112[]]  Interference with the operator or operation of a public transit vehicle.  (1)  A person commits the offense of interference with the operator or operation of a public transit vehicle if the person interferes with the operation of a public transit vehicle or lessens the ability of the operator to operate the public transit vehicle by:

     (a)  Intentionally, knowingly, or recklessly causing bodily injury to the operator of the public transit vehicle; [or]

     (b)  Threatening, by word or conduct, to cause bodily injury to the operator of the public transit vehicle with the intent to terrorize, or in reckless disregard of the risk of terrorizing the operator of the public transit vehicle[.]; or

     (c)  Intentionally, knowingly, or recklessly causing the malfunction or breakdown of an automated operation of a public transit vehicle, system, or service.

     (2)  For the purposes of this section[, "public]:

     "Automated operation" includes any operation of the public transit vehicle, system, or service that is performed entirely or partially by computer, network, or artificial intelligence or remotely by human action by means of computer or network connection.  "Automated operations" includes the opening and closing of doors and windows, the playing of any audio message or music, the movement of the public transit vehicle on the track, or the arrival or departure from any transit station.

     "Public transit vehicle" is a public paratransit vehicle providing service to the disabled, any transit vehicle used for the transportation of passengers in return for legally charged fees or fares, any transit vehicle owned or operated by a government entity, any school bus, or any taxi.

     (3)  Interference with the operator or operation of a public transit vehicle is a class C felony."

     SECTION 2.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.

     SECTION 3.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
