RELATING TO MICROBEADS.

Beginning 7/1/2021: bans the manufacture of a personal care product, except a non-prescription drug, that contains synthetic plastic microbeads. Beginning 7/1/2022: bans the sale or offer for sale of a personal care product, except a non-prescription drug, that contains synthetic plastic microbeads and bans the manufacture of a non-prescription drug that contains synthetic plastic microbeads. Beginning 7/1/2023: bans the sale or offer for sale of a non-prescription drug that contains synthetic plastic microbeads. Specifically exempts rinse-off cosmetics and rinse-off cosmetics that are also non-prescription drugs regulated by the federal Microbead-Free Waters Act of 2015. (SD1)

Prohibits any waste or disposal facility from being located in a conservation district except in emergency circumstances to mitigate significant risks to public safety and health. Requires no less than a one-half mile buffer zone for the construction, operation, modification, or expansion of a waste or disposal facility. (SD1)

Establishes the time of transfer individual wastewater system inspection program to oversee the inspection and repair of any individual wastewater system at the time of the property's sale or transfer. Excludes certain sales or transfers.

RELATING TO LAND USE.

Authorizes county land use decision-making authorities to amend district boundaries involving land areas greater than fifteen acres, except non important agricultural land or rural land areas greater than fifteen acres but no more than twenty-five acres if the land areas are proposed for reclassification to the urban district and at least sixty per cent of the land areas will be dedicated for the development of affordable housing. Effective 12/31/33. (SD1)

RELATING TO TRAILS.

Requires government entities that engage in search and rescue operations to seek reimbursement when the rescued person required search and rescue efforts because that person acted in disregard of that person's safety, including intentionally disregarding a warning or notice. Creates a penalty for restricting public access to a trail. Creates a penalty for entering or remaining unlawfully on a trail or state land that has been closed to public use. (SD1)

Makes clarifications regarding removal of unauthorized vessels on state property. Makes clarifications regarding the definition of an abandoned vessel. Changes the time limit to claim an unauthorized vessel that is impounded by the department of land and natural resources from thirty days to ten working days. Changes the time limit to claim an abandoned vessel that is impounded by a state or county agency from twenty days to ten working days. Makes abandonment of a vessel on waters of the State or public property a petty misdemeanor. Makes clarifications to auction requirements regarding abandoned vessels. Sets the time limit for a vessel owner or operator to remove unauthorized, abandoned, and grounded vessels at twenty-four hours. Allows DLNR to charge an impound storage fee. Effective 12/31/33. RELATING TO AGRICULTURAL LEASES.

Gives preference rights for an agricultural park lot and a non-agricultural park land lease to lessees who have made a significant improvement to the land that furthers commercial agricultural operations. Adds the same preferences for a non-agricultural park land lease as those for an agricultural park lot lease. Requires the department of agriculture to define "agricultural improvement" in administrative rules. (SD1)

Beginning 1/1/2025, prohibits the confinement of specified farm animals in a cruel manner and prohibits business owners and operators from selling certain products made from those animals. (SD1)
