Establishes a pilot project for the State to provide lease space for the establishment of child care facilities at any capital district building, except Honolulu Hale, with enrollment priority for children of state employees who work in the building at which the child care facility is located. Appropriates funds. Repeals 6/30/2023. Effective 12/31/2059.

Amends the income tax credit for expenses for household and dependent care services necessary for gainful employment by changing the taxpayer's applicable percentage of employment‑related expenses that constitutes the tax credit and cap amount. Takes effect on 12/31/2059.

RELATING TO HEALTH.

Requires DHS, upon approval from the Centers for Medicare and Medicaid Services, to establish and implement a program for providing home- and community-based services to at-risk individuals having intellectual or developmental disabilities who meet certain criteria. Seeks approval, no later than June 30, 2021, from the Centers for Medicare and Medicaid Services to provide coverage for services established under the program. Appropriates funds. Effective December 31, 2059.

RELATING TO THE SEXUAL EXPLOITATION OF CHILDREN.

Establishes a statewide coordinator and program within DHS to address the needs of sexually exploited children. Establishes the commercial sexual exploitation of children steering committee. Requires the steering committees to submit reports to the legislature by July 1, 2021, and July 1, 2022. Appropriates funds. Takes effect 12/31/2059.

RELATING TO DOMESTIC VIOLENCE.

Amends the offense of abuse of family or household members to provide for a lesser included petty misdemeanor offense. Allows a deferred acceptance of guilty plea in cases involving misdemeanor and petty misdemeanor abuse offenses. Requires the judiciary to submit annual reports to the legislature on the number and outcome of abuse of family or household members cases. Sunsets pilot program 6/30/2023. Takes effect 12/31/2059.

Appropriates funds to the Hawaii Public Housing Authority for rent subsidy payments, which sums shall be added to the Authority's base budget, and additional staff. Effective 7/1/2025.

RELATING TO THE LOW-INCOME HOUSING TAX CREDIT.

Specifies that certain provisions of the Internal Revenue Code related to at-risk rules and deductions and passive activity loss do not apply to the state low-income housing tax credit allocations after 12/31/2020. Extends the time period in which to claim the low-income housing tax credit. Enables state partnerships to claim the tax credit even if the partnerships are not considered partners for federal tax purposes. Takes effect 7/1/2025.

Adjusts the amount of the income tax credit for low-income household renters based on adjusted gross income and taxpayer filing status and provides for automatic adjustments to the tax credit based on the consumer price index. Take effect on 7/1/2025.

Temporarily exempts affordable housing projects from specific state fees related to discretionary approval or ministerial permitting, except application fees; provided that the units are affordable for households with incomes at or below 100% of the area median family income. Sunsets on 6/30/2026. Effective 7/1/2025.

Extends the deadline for the Hawaii housing finance and development corporation to exercise its power of eminent domain to acquire the Front Street Apartments affordable housing project on Maui unless the ground lease is renegotiated or a new ground lease is issued. Extends the deadline to obtain land use approvals for the Lealii affordable housing project on Maui. Effective 7/1/2025.

RELATING TO AFFORDABLE HOUSING.

Provides that an exemption from the general excise tax established by section 201H-36, Hawaii Revised Statutes, that has been approved by the Hawaii housing finance and development corporation shall be provided once the qualified person or firm has filed or recorded the regulatory agreement in land court or the bureau of conveyances, whichever is appropriate. Effective 7/1/2025.

RELATING TO HOUSING.

Consolidates the administration of low- and moderate-income housing into a single program by authorizing the Hawaii Housing Finance and Development Corporation to administer new reserved housing and workforce housing units in community development districts. Provides that the Hawaii Housing Finance and Development Corporation may adopt rules to allow owners to obtain home equity lines of credit, refinance their units, or pay their shared equity. Effective 7/1/2025.

Establishes the self-help homeownership housing revolving fund to provide for loans and project-related technical assistance grants to nonprofit housing development organizations to support the development of affordable homeownership housing projects under a self-help housing program. RELATING TO HOUSING.

Directs the HHFDC to take title to a specified 15.418-acre parcel in Honokaa, Hawaii county, if HHFDC finds, after its due diligence, that the parcel is suitable for residential development. Requires HHFDC to document any change in title. Requires HHFDC to conduct a feasibility study to determine whether the parcel is suitable for residential development. Appropriates funds for the feasibility study. Takes effect on 7/1/2025.

Status

RELATING TO PUBLIC LANDS.

Exempts lands set aside by the Governor to HHFDC for the primary purpose of developing affordable housing from classification as public land subject to DLNR management. Provides that lands set aside to HHFDC and no longer needed for housing, finance, and development purposes be returned to the public trust administered by DLNR. Takes effect on 7/1/2025.
