Sir:

 

     Your Committee on Intrastate Commerce, to which was referred H.B. No. 2324 entitled:

 

"A BILL FOR AN ACT RELATING TO STATE SERVICE FEES,"

 

begs leave to report as follows:

 

     The purpose of this measure is to expand the authority to increase or decrease fees or nontax revenues, subject to the approval of the Governor, to include all fees collected by the Department of Commerce and Consumer Affairs.

 

     Your Committee received testimony in support of this measure from the Department of Commerce and Consumer Affairs (DCCA).

 

     Your Committee has amended this measure by:

 

     (1)  Reverting statutory language that itemizes the chapters subject to DCCA's authority to increase or decrease fees;

 

     (2)  Specifying that DCCA's authority to set fees applies to decreasing fees only rather than increasing or decreasing fees, except for chapters otherwise itemized under section 92-28(1), Hawaii Revised Statutes;

 

     (3)  Changing the effective date to July 1, 2050, to encourage further discussion; and

 

     (4)  Making technical, nonsubstantive amendments for the purposes of clarity, consistency, and style.

 

     As affirmed by the record of votes of the members of your Committee on Intrastate Commerce that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 2324, as amended herein, and recommends that it pass Second Reading in the form attached hereto as H.B. No. 2324, H.D. 1, and be referred to your Committee on Consumer Protection & Commerce.
