     Your Committee on Consumer Protection & Commerce, to which was referred H.B. No. 1860, H.D. 1, entitled:

 

"A BILL FOR AN ACT RELATING TO WATER POLLUTION,"

 

begs leave to report as follows:

 

     The purpose of this measure is to prohibit the sale and distribution of sunscreens containing octocrylene, octisalate, and homosalate within the State, and authorize the Department of Health to adopt rules to prohibit additional chemicals.

 

     Your Committee received testimony in support of this measure from Friends of Hanauma Bay, Hawaii Reed and Ocean Coalition, Fair Wind Cruises and Kona Sunrise Charters, Kokua Sun Care, and three individuals.  Your Committee received testimony in opposition to this measure from Retail Merchants of Hawaii, Hawaii Food Industry Association, and Personal Care Products Council.  Your Committee received comments on this measure from the Department of Health.

 

     Your Committee finds that in 2018, legislation was enacted to ban sunscreens containing oxybenzone and octinoxate from sale and distribution in the State to preserve its marine ecosystems.  Banning three more chemicals contained in sunscreens, octocrylene, octisalate, and homosalate, from sale and distribution in Hawaii will further contribute to preservation of the State's marine life.

     Your Committee has amended this measure by making technical, nonsubstantive amendments for the purposes of clarity, consistency, and style.

 

     As affirmed by the record of votes of the members of your Committee on Consumer Protection & Commerce that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 1860, H.D. 1, as amended herein, and recommends that it be referred to your Committee on Finance in the form attached hereto as H.B. No. 1860, H.D. 2.
