A BILL FOR AN ACT

 

 

RELATING TO THE NA WAI EHA WATERSHED.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that the Na Wai Eha watershed in Wailuku, Maui, provides significant ecological, cultural, and hydrological value to the island of Maui.  It is composed of native koa, ohia, and lama forests and includes hidden valleys and mountains reaching five thousand feet.  It serves as the habitat for over forty-five endangered species and is the principal source of Maui's drinking water.  Nearly nine thousand acres of this critical watershed is up for sale, providing a rare opportunity to preserve this enormous section of the West Maui mountains in perpetuity for public recreation and benefit.

     The purpose of this Act is to appropriate funds from the land conservation fund for the acquisition of a portion of the Na Wai Eha watershed in Wailuku, Maui, to protect its scenic, environmental, and cultural value.

     SECTION 2.  There is appropriated out of the land conservation fund the sum of $           or so much thereof as may be necessary for fiscal year 2020-2021 for the land acquisition of 8,898.7 acres of the Na Wai Eha watershed in Wailuku, Maui; provided that no funds shall be made available under this Act unless the county of Maui provides matching funds of at least $           for the purpose for which this sum is appropriated or for the purchase of the associated water systems and easements offered by the seller.  This project is deemed necessary to qualify for federal aid financing and reimbursement.  The sum appropriated is anticipated to be supplemented by federal funds.

     The sum appropriated shall be expended by the department of land and natural resources for the purposes of this Act.

     SECTION 3.  The appropriation made in section 2 of this Act shall not lapse at the end of the fiscal year for which the appropriation is made; provided that all moneys from the appropriation that are unencumbered as of June 30, 2022, shall lapse as of that date.

     SECTION 4.  This Act shall take effect on July 1, 2051.
