A BILL FOR AN ACT

 

 

RELATING TO THE TRANSITIONS CLINIC NETWORK PILOT PROGRAM.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that the high incarceration rates cost state government and taxpayers millions of dollars year after year.  In fiscal year 2019, Hawaii had an average combined monthly jail and prison population of 5,217 inmates in both state and private mainland facilities.  Additionally, a large amount of the State's incarcerated population need health care services during and after incarceration, including mental health services.

     The legislature further finds that a transitions clinic network program provides a patient-centered primary care facility for chronically-ill returning prisoners.  The program, designed in partnership with formerly incarcerated individuals, is based within safety-net community health centers in neighborhoods most impacted by incarceration.  Each clinic provides linkages with correctional partners to provide continuity of care, easy access to comprehensive primary care, culturally competent patient-centered medical services, and close partnerships with local reentry organizations to address social determinants of health.  The program also addresses the complex barriers that patients and health systems face when trying to improve the health and health care of chronically-ill individuals who return from incarceration.

     The purpose of this Act is to appropriate funds to the department of human services to procure the services of a master contractor to manage subcontracts and expenditures for a transitions clinic network pilot program.

     SECTION 2.  (a)  There is appropriated out of the general revenues of the State of Hawaii the sum of $300,000 or so much thereof as may be necessary for fiscal year 2020-2021 for the department of human services to procure the services of a master contractor to manage subcontracts and expenditures for a transitions clinic network pilot program.

     (b)  The following provisions shall apply to the appropriation under subsection (a):

     (1)  The department of human services shall:

          (A)  Procure the services of a master contractor to procure and oversee subcontracts for a transitions clinic network pilot program, in accordance with chapter 103D or 103F, Hawaii Revised Statutes;

          (B)  Oversee the funds expended by the master contractor; and

          (C)  Develop policies and procedures for a fair and equitable procurement process for subcontractors made between the master contractor and subcontracted provider agencies that are consistent with the goals of public accountability and public procurement practices;

     (2)  The master contractor shall:

          (A)  Operate a transitions clinic network pilot program; provided that the program shall:

               (i)  Be an evidence-based model of care;

              (ii)  Cater to individuals released from prison with chronic health conditions;

             (iii)  Provide continuity of care after release;

              (iv)  Provide easy access to comprehensive primary care;

               (v)  Provide participants with patient-centered primary health care facilities;

              (vi)  Create partnerships with local reentry organizations;

             (vii)  Allow community health workers to connect participants to health and social services;

            (viii)  Allow community health workers to assist participants with navigating through post-release life; and

              (ix)  Create system enhancements for patient-centered services, including but not limited to early access to primary care, behavioral health integration, and medication-assisted treatment for substance use disorders;

          (B)  At a minimum, provide quarterly reports to the house of representatives and senate committees on housing and human services;

          (C)  Develop reporting procedures and timelines for providing performance information to respective state agencies;

          (D)  Use the funds for the implementation and operation of the transitions clinic network pilot program, including program implementation in one primary care health clinic, training and salaries and benefits of two community health workers, and staff computers and other supplies; and

          (E)  Be accountable for funds expended;

     (3)  The master contractor may retain administrative fees up to fifteen per cent in total from the amounts paid under the master contract between the master contractor and subcontractors; and

     (4)  The total sum of funding shall be provided at the start of the transitions clinic network pilot program to be managed by the master contractor.

     The sum appropriated shall be expended by the department of human services for the purposes of this Act.

     SECTION 3.  This Act shall take effect on January 1, 2021.
