A BILL FOR AN ACT

 

 

relating to highway patrol.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that law enforcement service and assistance along state highways is inadequate.  Further, local police and state sheriffs do not have sufficient time and resources to provide these services.

     Accordingly, the purpose of this Act is to establish a state highway patrol within the sheriff division of the department of public safety.

     SECTION 2.  Chapter 353C, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§353C-     Highway patrol.  (a)  There is established within the sheriff division of the department a state highway patrol that shall consist of law enforcement officers appointed by the sheriff, who shall fix their compensation.

     (b)  The state highway patrol shall enforce title 17 and all other state and county laws, ordinances, and rules regulating traffic; provided that the state highway patrol's jurisdiction shall be limited to property and roads that are owned or leased by the State.

     (c)  State highway patrol officers shall have and may exercise all of the powers and authority and the benefits and privileges of a deputy sheriff, including the power to arrest; provided that these powers shall remain in force and effect only while in actual performance of their duties; provided further that these powers and authority shall not extend to any properties or roads that are not owned or leased by the State."

     SECTION 3.  There is appropriated out of the general revenues of the State of Hawaii the sum of $          or so much thereof as may be necessary for fiscal year 2020-2021 for the establishment of a state highway patrol within the sheriff division of the department of public safety, including but not limited to the following:

     (1)  The acquisition of any necessary equipment, firearms, uniforms, and vehicles;

     (2)  The acquisition, leasing, or construction of any necessary offices and facilities, including any facilities necessary for the storage of state highway patrol vehicles; and

(3)  Salaries and benefits for both law enforcement and non-law enforcement personnel.

     The sum appropriated shall be expended by the sheriff division of the department of public safety for the purposes of this Act.

     SECTION 4.  New statutory material is underscored.

     SECTION 5.  This Act shall take effect on July 1, 2020.
