A BILL FOR AN ACT

 

 

relating to public transportation.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 78, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§78-    Public transportation subsidy program.  (a)  The department of accounting and general services shall establish and implement a public transportation subsidy program that allows a state employee to offset the monthly cost of commuting to work via public transportation.  Under the public transportation subsidy program, a state employee may elect to receive a monthly subsidy not to exceed $          .

     (b)  Nothing in this section shall prevent a state agency from offering a more generous public transportation subsidy program that is otherwise consistent with the requirements of this section.  Nothing in this section shall require a state employee to change their method of commute.  This section shall not be construed to absolve any state agency or other party from any obligation required by an existing collective bargaining agreement with employees or any provision of law.

     (c)  The department of accounting and general services may adopt rules pursuant to chapter 91 necessary to implement this section.

     (d)  For purposes of this section:

     "Public transportation" means services involved in the transportation of passengers for hire by means of street railway, elevated railway, subway, underground railroad, motor vehicles, or other means of conveyance generally associated with or developed for mass surface or subsurface transportation of the public.  "Public transportation" does not include any service involved in transportation by taxicab, transportation network company, airport limousine, or industrial bus.

     "State agency" means the executive, legislative, or judicial branches of state government, including departments, offices, commissions, boards, or other agencies within the executive, legislative, or judicial branches."

     SECTION 2.  There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2020-2021 for the public transportation subsidy program.

     The sum appropriated shall be expended by the department of accounting and general services for the purposes of this Act.

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect on July 1, 2020.
