A BILL FOR AN ACT

 

 

relating to government employees.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


SECTION 1. The purpose of this Act is to mitigate the erosion of public confidence in government servants. Given recent convictions of government officers and employees, the integrity of government institutions has come into question.

Investigations into public corruption are particularly troublesome because of the appearance of impropriety when an elected or appointed officer or employee who is suspected of criminal conduct continues to serve in their official capacity. Even more troublesome is the fact that a suspected government officer or employee is able to collect their full salary and benefits while the target of a criminal investigation and is allowed to keep these benefits even upon conviction of the criminal offense of which they were suspected.

SECTION 2. Chapter 78, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"78- Forfeiture; felony convictions. Any person convicted of a felony committed in the course of performing the services of an officer or employee of the State or any of its counties shall forfeit all:

(1) Compensation paid;

(2) Vacation and sick leave accrued; and

(3) Chapter 88 membership service attributed,

to the officer or employee for the period from the date the felony offense was committed through the end of the officer's or employee's employment by the State or county; provided that this section shall not impair or diminish compensation and benefits accrued prior to the date the felony was committed."

SECTION 3. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.

SECTION 4. New statutory material is underscored.

SECTION 5. This Act shall take effect upon its approval.
