A BILL FOR AN ACT

 

 

RELATING TO LAND USE.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that not only is climate change real, but it is the overriding challenge of the twenty-first century and one of the priority issues of the legislature.  Climate change poses immediate and long-term threats to the State's economy, sustainability, security, and way of life.

     The legislature recognizes that eroding coastlines threaten the State's assets that serve as critical infrastructure, including the State's highway system.

     The legislature also recognizes that the department of transportation has completed the State of Hawaii Statewide Coastal Highway Program Report, which utilized a methodology to prioritize coastal roads threatened by coastal hazards and climate change and identified segments of highway along Hauula on Oahu as most critical.

     The legislature further finds that the department of transportation has had to conduct emergency repairs along portions of the coastal highways in Hauula in April 2019 and again in January 2020, and that mid-term and long-term solutions must be identified to ensure that the public has access to safe, efficient, and sustainable transit corridors to enhance the mobility of people and goods and support economic vitality and livability.

     The legislature finds that mid-term and long-term solutions require land use planning that addresses economic, social, public health, and environmental considerations to promote the efficient use of resources for the future of the State.

     The purpose of this Act is to identify climate adaptation strategy options that address the impacts of coastal erosion on coastal highways by:

     (1)  Requiring the office of planning to conduct a land use study for Hauula, Oahu, that assesses the viability and cost of maintaining the transit corridor, including mid- and long-term adaptation strategies associated with accommodating, protecting, and if necessary, relocating, the corridor for the best interest of the State; and

     (2)  Appropriating funds to the office of planning for the purposes of this Act.

     SECTION 2.  The office of planning shall conduct a land use study for Hauula, Oahu, that assesses the viability and cost of maintaining the transit corridor, including mid- and long-term adaptation strategies associated with accommodating, protecting, and if necessary, relocating, the corridor for the best interest of the State.

     SECTION 3.  There is appropriated out of the general revenues of the State of Hawaii the sum of $250,000 or so much thereof as may be necessary for fiscal year 2020-2021 for the office of planning to conduct the land use study pursuant to this Act.

     The sum appropriated shall be expended by the office of planning for the purposes of this Act.

     SECTION 4.  This Act shall take effect on July 1, 2050.
