A BILL FOR AN ACT

 

 

RELATING TO PARKING FOR DISABLED PERSONS.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that currently the minimum number of accessible parking spaces is regulated by the 2010 Americans with Disabilities Act Accessibility Guidelines.  For parking lots with five hundred or less total parking spaces, the formula is not a percentage.  Rather, the guidelines provide brackets based on total lot size and the minimum number of accessible spaces for each bracket.

     The legislature further finds that before proceeding with a plan to increase the number of accessible parking stalls in the State, there should be a review of the number of disabled parking permits issued and still in effect and consideration of how increasing the number of accessible parking stalls would impact different communities.

     The purpose of this Act is to require the department of health to convene a working group to examine increasing the number of accessible parking stalls in the State.

     SECTION 2.  (a)  The department of health shall convene a working group to examine the issues surrounding increasing the number of accessible parking stalls in the State based on various cost versus need factors, including:

     (1)  The number of disability parking permits currently issued and active; and

     (2)  The need for additional accessible parking spaces in various communities and settings, including but not limited to a rural versus an urban setting, a shopping center facility versus a medical or hospital facility, and the different needs for accessible parking stalls in places of public accommodation in each of the counties.

     (b)  The department of health shall be a part of the working group.

     (c)  The department of health shall submit a report of the working group's findings and recommendations, including any proposed legislation, to the legislature no later than twenty days prior to the convening of the regular session of 2021.

     SECTION 3.  This Act shall take effect on December 31, 2059.
