A BILL FOR AN ACT

 

 

RELATING TO HEALTH.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 328, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§328-    Cannabidiol products; product testing.  (a)  All products containing cannabidiol or marketed or sold as containing cannabidiol shall only be sold in the State if:

     (1)  The product has a certificate of analysis prepared by an independent testing laboratory that states the product does not contain contaminants unsafe for human consumption and contains a total delta-9-tetrahydrocannabinol concentration that does not exceed 0.3 per cent on a dry-weight basis pursuant to the testing of a random sample of the batch; and

     (2)  The product is sold or distributed in packaging that includes:

          (A)  A scannable barcode or quick reference code linked to the certificate of analysis of the product by an independent testing laboratory;

          (B)  The batch number;

          (C)  The internet address of a website where batch information may be obtained;

          (D)  The expiration date;

          (E)  The number of milligrams of cannabidiol;

          (F)  A statement that the product contains a total delta-9-tetrahydrocannabinol concentration that does not exceed 0.3 per cent on a dry-weight basis; and

          (G)  A statement certifying that the product is free from contaminants that are unsafe for human consumption.

     (b)  For purposes of this section, "independent testing laboratory" means a laboratory that:

     (1)  Does not have a direct or indirect interest in the entity whose product is being tested;

     (2)  Does not have a direct or indirect interest in a facility that cultivates, distributes, dispenses, or sells cannabidiol, hemp, or hemp extract in the State or in another jurisdiction; cultivates, processes, distributes, or sells marijuana, as defined in sections 329-1 and 712-1240; or holds a medical cannabis dispensary license pursuant to chapter 329D; and

     (3)  Is accredited by a third-party accrediting body as a competent laboratory pursuant to ISO/IEC 17025 of the International Organization for Standardization."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect on July 1, 2020.
