Your Committee on Transportation, to which was referred H.B. No. 2464 entitled:
"A BILL FOR AN ACT RELATING TO THE USE OF INTOXICANTS WHILE OPERATING A VEHICLE,"
begs leave to report as follows:
The purpose of this measure is to protect public safety by lowering the blood alcohol concentration (BAC) in a person's breath or blood from 0.08 to 0.05 for the offense of operating a vehicle while under the influence of an intoxicant.
Your Committee received testimony in support of this measure from the Department of Transportation, Office of the Mayor of the County of Hawaii, three members of the Maui County Council, Honolulu Police Department, Maui Metropolitan Planning Organization, Mothers Against Drunk Driving Hawaii, National Safety Council, Hawaii Public Health Association, Advocates for Highway and Auto Safety, KidsAndCars.org, Liam's Life Foundation, and Mothers Against Drunk Driving. Your Committee received testimony in opposition to this measure from the Office of the Public Defender. Your Committee received comments on this measure from the American Beverage Institute and two individuals.
Your Committee finds that research has demonstrated that critical driving skills are diminished at 0.05 BAC and that this level of impaired driving significantly increases the risk of senseless and preventable collisions that could take the lives of innocent motorists, cyclists, and pedestrians.
As affirmed by the record of votes of the members of your Committee on Transportation that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 2464 and recommends that it pass Second Reading and be referred to your Committee on Judiciary.
