     Your Committee on Energy & Environmental Protection, to which was referred H.B. No. 1052 entitled:




begs leave to report as follows:


The purpose of this measure is to limit electric vehicles from parking in non-metered parking stalls free of charge to an initial four-hour period.


     Your Committee received testimony in support of this measure from the Hawaii Automobile Dealers' Association and one individual.  Your Committee received testimony in opposition to this measure from and seven individuals.  Your Committee received comments on this measure from the Department of Accounting and General Services, Department of Transportation, Hawaii State Energy Office, Blue Planet, Ulupono Initiative, and one individual.


     Your Committee finds that the public parking garages at airports, such as the Daniel K. Inouye International Airport (Airport), have reached capacity.  On average, the Airport has up to 20 percent of the 4,740 public parking stalls occupied by 933 electric vehicles on an average day.  Your Committee further finds that there is a need to extend the sunset date for parking fee benefits for electric vehicles, and to clarify and strengthen the enforcement of electric vehicle parking laws, including penalties for electric vehicle charging stations where no reasonable effort is made to maintain the station in working order.


     Your Committee has amended this measure by:


     (1)  Excluding from the electric vehicle parking fee exemption any parking at any airport in the State;


     (2)  Extending the repeal date of the electric vehicle parking benefits law, Act 168, Session Laws of Hawaii 2012, as amended, until 10 percent of passenger vehicles registered in Hawaii are electric vehicles;


     (3)  Requiring certain places of public accommodation to make reasonable efforts to maintain electric vehicle charging systems in working order;


     (4)  Requiring each new electric vehicle charging system installed or placed in service pursuant to the electric vehicle charging system requirement to be at least a Level 2 charging system and network capable;


     (5)  Inserting a savings clause;


     (6)  Changing its effective date to July 1, 2050; and


     (7)  Making technical, nonsubstantive amendments for the purposes of clarity, consistency, and style.


     As affirmed by the record of votes of the members of your Committee on Energy & Environmental Protection that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 1052, as amended herein, and recommends that it pass Second Reading in the form attached hereto as H.B. No. 1052, H.D. 1, and be referred to your Committee on Transportation.
