A BILL FOR AN ACT

 

 

RELATING TO CONSUMER PROTECTION.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 489J, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§489J-    Electronic receipts.  (a)  Each proof of purchase for the retail sale of tangible personal property or for the provision of services to a consumer by a business shall be provided only in electronic form, unless the consumer requests that the proof of purchase be provided in paper form.

     (b)  Any violation of subsection (a) shall be subject to the following remedies enforceable by the attorney general or director of the office of consumer protection:

     (1)  For the first and second violation, the business shall receive a notice of violation; and

     (2)  For the third violation and every subsequent violation, a fine in the sum of $25 per violation; provided that:

          (A)  The sums shall not exceed $300 in the aggregate in a calendar year; and

          (B)  The sums shall be collected in a civil action."

     SECTION 2.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
