A BILL FOR AN ACT

 

 

relating to health.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Section 461-11, Hawaii Revised Statutes, is amended to read as follows:

     "§461-11  Duties of registered pharmacist.  (a)  Every registered pharmacist in charge of a pharmacy shall comply with all laws and rules.  The pharmacist shall be responsible for the management of the pharmacy and every activity thereof which is subject to this chapter shall be under the pharmacist's complete control.

     (b)  All registered pharmacists shall notify the board of changes of business address within ten days.

     (c)  No registered pharmacist shall accept for return or exchange any prescription drug once the drug has been dispensed or sold by prescription; provided that every registered pharmacist shall accept a prescription drug for return if:

     (1)  The prescription drug is a controlled substance and the pharmacist is authorized as a collector to accept controlled substances for disposal pursuant to 21 Code of Federal Regulations part 1317; or

     (2)  The prescription drug is the subject of a patient level recall issued by the drug's manufacturer or requested by the United States Food and Drug Administration."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.

Description:

Prohibits registered pharmacists from accepting prescription drugs for return or exchange once the drug has been dispensed or sold by prescription unless the pharmacist is an authorized collector for the disposal of controlled substances or the prescription drug is subject to a patient level recall.
