A BILL FOR AN ACT

 

 

relating to unfair and deceptive practices.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 481B, Hawaii Revised Statutes, is amended by adding a new section to part I to be appropriately designated and to read as follows:

     "§481B-     Charges for mileage, travel fees.  No person engaged in the business of offering goods or services for sale may charge a customer additional fees for the costs of mileage or travel incurred by the person in the delivery of the goods or services sold to the customer unless:

     (1)  The customer receives prior disclosure of the additional fees for mileage or travel;

     (2)  The additional fees for mileage or travel are set forth in the bill or invoice separately from the sales price of the goods or services;

     (3)  The person justifies the additional fees through an itemization of the fees; and

     (4)  The additional fees charged by the person are reasonably related to the actual costs incurred by the person for mileage or travel; provided that the additional fees shall not exceed the actual costs by more than        per cent."

     SECTION 2.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
