A BILL FOR AN ACT

 

 

relating to health INSURANCE.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  (a)  Upon approval by the Secretary of the United States Department of Health and Human Services pursuant to subsection (b), the director of human services, to the extent allowed by law, shall:

     (1)  Establish the Hawaii care plan within the State's medicaid program, which shall make health insurance coverage available to any individual in the State who would not otherwise qualify to enroll in medicaid;

     (2)  Contract with one or more insurers to provide health coverage to individuals who enroll in the Hawaii care plan; and

     (3)  Make coverage through the Hawaii care plan available for purchase through the federal health insurance marketplace.

     (b)  The director of human services shall apply to the Secretary of the United States Department of Health and Human Services for any necessary waiver pursuant to 42 United States Code section 1315 or section 18052, as applicable, to:

     (1)  Authorize the director of human services to contract with one or more insurers to provide health coverage to individuals who enroll in the Hawaii care plan pursuant to subsection (a); and

     (2)  Allow an individual who is determined to be eligible for advance payments of the premium tax credit and cost-sharing reductions pursuant to 45 Code of Federal Regulations section 155.305 to use those credits and reductions to enroll in the Hawaii care plan.

     (c)  Health coverage provided to an individual enrolled in the Hawaii care plan shall be subject to the same terms as the health coverage provided to individuals enrolled in medicaid who do not participate in a medicaid managed care program; provided that coverage for non-emergency transportation services may be excluded from coverage under the Hawaii care plan.

     (d)  The department shall adopt rules pursuant to chapter 91, Hawaii Revised Statutes, to implement this section.

     SECTION 2.  This Act shall take effect upon its approval.
