RELATING TO NONPROFIT CORPORATIONS.

Amends Chapter 414D, Hawaii Revised Statutes, to clarify that public benefit corporations may not purchase its memberships, to clarify that a person who does not have authority to vote as a member of the board is not a director, to clarify that a corporation with members may designate its directors, to add previous wording that was inadvertently removed through Act 87, Session Laws of Hawaii 2017, and to increase the length of time that the Attorney General has to review proposed sale of substantially all of the assets of public benefit corporations other than in the regular course of its activities.

RELATING TO GRANTS.

Requires all organizations that may receive a grant from the State to be in compliance with all registration and annual reporting requirements of the Department of Commerce and Consumer Affairs and provide proof of a current and valid general excise tax license.  Requires all nonprofit organizations that may receive a grant from the State to provide proof of a current and valid general excise tax license; register with the Department of the Attorney General as a charitable organization, if applicable; provide proof of the filing of Internal Revenue Service form 990, 990EZ, or 990-N; and be current on the payment of all real property taxes, if applicable.

RELATING TO DENTISTRY.

Amends the ethics training requirement for dentists in the continuing education program to be six hours of ethics training within the previous two years.

SB 2160

RELATING TO UNMANNED AERIAL VEHICLES.

Establishes a new chapter to regulate the use of unmanned aerial vehicles.  Requires the director of the Department of Commerce and Consumer Affairs to adopt rules as necessary.  Establishes prohibited uses of unmanned aerial vehicles and penalties, and authorizes civil action for violations.  Makes certain uses of an unmanned aerial vehicle a misdemeanor.  Clarifies that under certain circumstances, the used of an unmanned aerial vehicle may constitute an invasion of privacy.

RELATING TO CONDOMINIUMS.

Expands the scope of the condominium education trust fund to cover voluntary binding arbitration between interested parties.  Amends the conditions that mandate mediation and exceptions to mandatory mediation.  Makes conforming amendments.

RELATING TO TAXATION.

Amends the general excise tax law by adding a definition for "marketplace provider."  Provides that a person with no physical presence in the State shall be considered to be engaged in business in the State if, in any year, the person has gross receipts attributable to transactions in the State totaling $100,000 or more.

RELATING TO TOBACCO.

Prohibits the issuance of retail tobacco permits and sale of tobacco products and electronic smoking devices by businesses that are located within seven hundred fifty feet of a school, public park, or public housing complex.
