     Your Committee on Judiciary, to which was referred H.B. No. 2399, H.D. 1, entitled:

 

"A BILL FOR AN ACT RELATING TO HIGHWAY SAFETY,"

 

begs leave to report as follows:

 

     The purpose of this measure is to amend the definition of "drug", in regards to the offense of operating a vehicle under the influence of an intoxicant, to include any substance that impairs a person.

 

     The Department of Transportation, Hawaii Police Department, Department of the Prosecuting Attorney of the County of Maui, Honolulu Police Department, Office of the Prosecuting Attorney of the County of Kauai, Office of the Prosecuting Attorney of the County of Hawaii, Hawaii Strategic Highway Safety Plan, Hawaii Chapter of Mothers Against Drunk Driving, and a concerned individual testified in support of this measure.  The Office of the Public Defender testified in opposition to this measure.  The Consumer Healthcare Products Association provided comments.  

 

     As affirmed by the record of votes of the members of your Committee on Judiciary that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No. 2399, H.D. 1, and recommends that it pass Third Reading.
