A BILL FOR AN ACT

 

 

Relating to Public Reports.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 27, Hawaii Revised Statutes, is amended by adding a new section to part VII be appropriately designated and to read as follows:

     "§27-    Reports to the legislature; online database.  (a)  The office of enterprise technology services shall establish and maintain an online database that shall make available to the public all reports made to the legislature by any government agency.  For the purpose of this section, "government agency" means the judiciary, and each department, board, commission, or officer of the State or any of its political subdivisions.

     (b)  The database established by this section shall be online and accessible to the public through the Internet no later than January 1, 2018.

     (c)  Nothing in this section shall require the posting of any proprietary information or other information protected from disclosure by law or contract."

     SECTION 2.  Section 93-16, Hawaii Revised Statutes, is amended by amending subsection (a) to read as follows:

     "(a)  Notwithstanding any other statute, law, charter provision, ordinance, or rule to the contrary, whenever a government agency is required to submit a report to the legislature, the report shall be:

     (1)  Available in printed form;

     (2)  Submitted in printed form to the president of the senate, the speaker of the house of representatives, and the legislative reference bureau library; [and]

     (3)  Submitted in electronic form to the office of enterprise technology services, in a format prescribed by the office of enterprise technology services for inclusion in the online database required under section 27-   ; and

    [(3)] (4)  Posted on the designated central State of Hawaii website; or

    [(4)] (5)  Posted on the Internet in an easily-located manner."

     SECTION 3.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.

Description:

Requires the Office of Enterprise Technology Services to establish and maintain an online database of all reports to the legislature made by the judiciary and each department, board, commission, or officer of the State or any of its political subdivisions.  Requires the website be online and accessible to the public by 1/1/2018.
