A BILL FOR AN ACT

 

 

RELATING TO THE GENERAL EXCISE TAX.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 237, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§237-    Exemption; small farms.  (a)  This chapter shall not apply to payment received by a qualified small farmer for the sale of produce that is intended for human consumption within the State.  The gross proceeds of the sale of produce by a qualified small farmer shall be exempt from the tax imposed by this chapter for a maximum period of five years.

     This exemption shall not apply to sales of produce intended for human consumption outside of the State.

     (b)  For the purposes of this section:

     "Produce" means any fresh fruit or vegetable grown in the soil or hydroponically, regardless of whether organic, that is sold in the same general condition as when it was harvested.

     "Qualified small farmer" means a person or entity that cultivates the land in the State in order to grow produce for human consumption; provided that the produce for which an exemption is claimed under this section is grown on a parcel of land that:

     (1)  Is no larger than       acres; and

     (2)  Has been fallow for a period of not less than five consecutive years immediately prior to the year for which an exemption is first claimed under this section."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval and shall apply to gross income or gross proceeds received after December 31, 2016, and before January 1, 2022; provided that this Act shall be repealed on January 1, 2022.
