A BILL FOR AN ACT

 

 

RELATING TO MEDICAL MARIJUANA.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 329D, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§329D-    Tax revenues for mental health and substance abuse services.  Of the annual general excise tax revenues received from medical marijuana dispensaries, ten per cent shall be deposited into the mental health and substance abuse special fund established under section 334-15.

     Of the gross income generated by each entity that holds a medical marijuana dispensary license under this chapter, ten per cent shall be deposited into the mental health and substance abuse special fund established under section 334-15."

     SECTION 2.  Section 334-15, Hawaii Revised Statutes, is amended by amending subsection (a) to read as follows:

     "(a)  There is established a special fund to be known as the mental health and substance abuse special fund into which shall be deposited all revenues and other moneys collected from certification programs and treatment services rendered by the mental health and substance abuse programs operated by the State[.] and revenues collected from medical marijuana dispensaries pursuant to section 329D-  .  Notwithstanding any other law to the contrary, the department is authorized to establish separate accounts within the special fund for depositing moneys received from certification programs and from each mental health and substance abuse program.  Moneys deposited into the respective accounts of each program shall be used for the payment of the operating expenses of the respective program.  Moneys deposited in the fund from revenues collected from medical marijuana dispensaries, pursuant to section 329D‑  , may be used for the payment of the operating expenses of mental health and substance abuse programs operated by the State."

     SECTION 3.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect on July 1, 2017.

Description:

Specifies that ten per cent of general excise tax revenues collected from medical marijuana dispensaries and ten per cent of gross income generated by each entity that holds a medical marijuana dispensary license shall be allocated to the mental health and substance abuse special fund.  Authorizes moneys in the mental health and substance abuse special fund to be used for the payment of the operating expenses of mental health and substance abuse programs operated by the State.  (SD1)
