A BILL FOR AN ACT

 

 

relating to the land use commission.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that the land use commission establishes standards for determining the boundaries of the four major land use districts and assists in planned growth and important agricultural lands preservation.  The decisions and orders from the land use commission may set conditions on developers regarding developments on major land use districts.  Noncompliance of these conditions by a developer may impact the public's use, enjoyment, and purpose of the land, native Hawaiian gathering rights, and public infrastructure as well as federal and state environmental laws and the Hawaii state plan and county plans.  However, the land use commission lacks sufficient staff to monitor and ensure compliance of these conditions.

     The purpose of this Act is to appropriate funds for the land use commission to establish a planner IV full-time equivalent (1.0 FTE) position to monitor and ensure compliance of any conditions required by the land use commission regarding land use within the four major land use districts.

     SECTION 2.  There is appropriated out of the general revenues of the State of Hawaii the sum of $75,000 or so much thereof as may be necessary for fiscal year 2017-2018 and the same sum or so much thereof as may be necessary for fiscal year 2018-2019 for the land use commission to establish a planner IV full-time equivalent (FTE 1.0) position to monitor and ensure compliance of any conditions required by the land use commission regarding land use within the four major land use districts.

     The sums appropriated shall be expended by the department of business, economic development, and tourism for the purposes of this Act.

     SECTION 3.  This Act shall take effect on July 1, 2017.
