A BILL FOR AN ACT

 

 

relating to THE university of hawaii.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that it is of a matter of statewide concern to support the contributions by the University of Hawaii to the economic health and diversification of the State.  The legislature further finds that the timely and efficient commercialization of intellectual property created by basic and applied research at the university will greatly benefit the public and the State.

     The purpose of this Act is to study and develop plans to establish and implement a center for commercialization at the University of Hawaii.

     SECTION 2.  In preparation for the establishment of a center for commercialization at the University of Hawaii by July 1, 2022, the university shall study and develop a plan to establish and implement a center for commercialization, a facility dedicated to fostering an environment conducive to commercializing the intellectual property created by basic and applied research at the university for the benefit of the public and the State.  The university shall submit annual reports on its plans for the center for commercialization, including its findings and recommendations, including any proposed legislation, to the legislature no less than twenty days prior to the convening of each regular session, commencing with the regular session of 2018 and ending, with the regular session of 2022.  The report, shall, among other things, identify and discuss:

     (1)  Currently existing resources and facilities at the University of Hawaii or any other state agency, including any applicable regulatory framework or programs, that may be used, consolidated, or incorporated into a center for commercialization;

     (2)  Policies, goals, mission statements, and guidelines for a center for commercialization;

     (3)  The organizational structure of a center for commercialization;

     (4)  Best practices, including organizational structure,  employment conditions, public-private partnerships, and research parameters, currently in place at universities with a center for commercialization or a similar or comparable program;

     (5)  Site selection parameters and site acquisition and development costs for a center for commercialization;

     (6)  Estimated construction and operational costs of a center for commercialization;

     (7)  Funding and financing sources, other than legislative appropriations, including federal, private, and public-private sources;

     (8)  Economic, social, and health benefits to the residents of the State that can be directly attributed to a center for commercialization;

     (9)  Any current legal impediments, including statutes or rules regarding technology transfers relating to the research by university employees and the organizational structure of the university;

    (10) Necessary annual legislative appropriations to develop a turnkey plan to establish a center for commercialization; and

    (11) Any other information relevant to establishing a center for commercialization.

     SECTION 3.  There is appropriated out of the general revenues of the State of Hawaii the sum of $         or so much thereof as may be necessary for fiscal year 2017-2018 and the same sum or so much thereof as may be necessary for fiscal year 2018-2019 to study and develop plans to establish and implement a center for commercialization at the University of Hawaii.

     The sums appropriated shall be expended by the University of Hawaii for the purposes of this Act.

     SECTION 4.  This Act shall take effect on July 1, 2017, and shall be repealed on June 30, 2022.
