A BILL FOR AN ACT

 

 

PROPOSING AN AMENDMENT TO ARTICLE XIII, OF THE HAWAII CONSTITUTION, TO ESTABLISH A COLLECTIVE BARGAINING FUND FOR THE REPRESENTATION OF PUBLIC EMPLOYEES IN COLLECTIVE BARGAINING NEGOTIATIONS.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The purpose of this Act is to propose an amendment to article XIII of the Constitution of the State of Hawaii to add a new section that would establish a collective bargaining fund for the representation of public employees in collective bargaining negotiations.

     SECTION 2.  Article XIII of the Constitution of the State of Hawaii is amended by adding a new section to read as follows:

"PUBLIC EMPLOYEES' COLLECTIVE BARGAINING FUND

     Section   .  There is established in the treasury the public employees' collective bargaining fund into which shall be deposited on the first day of each fiscal year an amount not less than       percent of the total compensation provided by the State to public employees during the previous fiscal year.  Moneys in the fund shall be expended by the exclusive collective bargaining representative for each respective unit in accordance with law; provided that the amount expended by the representative shall be proportional to the number of employees classified in the unit represented by the exclusive collective bargaining representative and the total number of public employees; provided further that the amount appropriated into the fund and the amount expended by the collective bargaining representative shall not be diminished by the State."

     SECTION 3.  The question to be printed on the ballot shall be as follows:

"Shall there be established a public employees' collective bargaining fund to be expended by the exclusive collective bargaining representative of each respective collective bargaining unit for the purpose of representing public employees in collective bargaining negotiations?"

     SECTION 4.  New constitutional material is underscored.

     SECTION 5.  This amendment shall take effect upon compliance with article XVII, section 3, of the Constitution of the State of Hawaii.
