A BILL FOR AN ACT

 

 

RELATING TO ENERGY EFFICIENCY.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


PART I

     SECTION 1.  (a)  There is established within the department of accounting and general services a building energy efficiency pilot program to set building energy efficiency standards that assist the State in reaching net zero emissions.

     (b)  The department of accounting and general services shall identify one state land site and construct a new state building or remodel an existing state facility to create an innovation center with net zero emissions.  The department of accounting and general services shall work with the department of business, economic development, and tourism and the department of transportation to identify a site.  The center shall utilize the following building energy efficiency standards:

     (1)  Lighter colored roofing material;

     (2)  Windows that use dynamic glass or chromatic glazing with the ability to change their performance properties;

     (3)  Rooftops with space available for the installation of photovoltaic or solar thermal panels;

     (4)  Sensor-based lighting control systems for lighting fixtures located near windows;

     (5)  High efficiency heating, ventilation, and air conditioning units; and

     (6)  Incorporation of natural light.

     (c)  In developing, constructing, and maintaining the new state building following the guidelines established under subsection (b), the department shall conduct an analysis of the cost and benefits of adopting the building energy efficiency standards, including the fiscal consequences to the State and the related cost savings from energy efficiency.  The department shall include payback periods of investment, taking into account the cost savings of the program.

     (d)  The department shall submit a report, including any proposed legislation, to the legislature no later than twenty days prior to the convening of the regular session of 2020, and shall include the following:

     (1)  Program evaluation metrics, including the details of the analysis conducted pursuant to subsection (c), a financial reporting of the annual costs of administering the pilot program, and any discrete costs necessary for the initial launch of the pilot program;

     (2)  A plan for the adoption of building efficiency standards catered to the industrial organization and structure and energy capacity and structure of the State, with consideration to the building and construction industry's capability for compliance;

     (3)  A plan that integrates the building energy efficiency standards to the State's building codes, including:

         (A)  A statutory analysis and proposed amendments needed to implement the standards statewide; and

         (B)  Any penalties and liabilities as may be necessary to compel compliance by the building and construction industry;

     (4)  A study on implementing the pilot program with residential units, including research and planning as required in paragraphs (1), (2), and (3); and

     (5)  A reasonable time period in years in which the State will achieve net zero emissions.

     SECTION 2.  There is appropriated out of the general revenues of the State of Hawaii the sum of $         or so much thereof as may be necessary for fiscal year 2017-2018 and the same sum or so much thereof as may be necessary for fiscal year 2018-2019 to implement the building energy efficiency pilot program.

     The sums appropriated shall be expended by the department of accounting and general services for the purposes of this Act.

PART II

     SECTION 3.  Section 107-27, Hawaii Revised Statutes, is amended to read as follows:

     "§107-27  Design of state buildings.  (a)  No later than one year after the adoption of rules under this chapter, the design of all state building construction shall be in compliance with the Hawaii state building codes, except state building construction shall be allowed to be exempted from:

     (1)  County codes that have not adopted the Hawaii state building codes;

     (2)  Any county code amendments that are inconsistent with the minimum performance objectives of the Hawaii state building codes or the objectives enumerated in this part; or

     (3)  Any county code amendments that are contrary to code amendments adopted by another county.

     (b)  Exemptions shall include county ordinances allowing the exercise of indigenous Hawaiian architecture adopted in accordance with section 46-1.55.

     (c)  For state buildings constructed or renovated on or after July 1, 2020, the design of state buildings shall encourage the use of natural light, and incorporate the use of glass that uses a dynamic glazing system where appropriate.

     As used in this subsection, "dynamic glazing system" means glazing systems that have the ability to reversibly change their performance properties."

PART III

     SECTION 4.  New statutory material is underscored.

     SECTION 5.  This Act shall take effect on July 1, 2050; provided that section 1 shall be repealed on June 30, 2020; and

provided further that section 3 of this Act shall take effect on July 1, 2020.
