RELATING TO THE DEPARTMENT OF THE ATTORNEY GENERAL.

Establishes the Legislative Division within the AG to provide legal services to the Legislature.  Requires the AG to submit a report to the Legislature on the progress of implementing the Division, its projected outcomes, and recommendations to amend the organizational structure of the AG.  Makes an appropriation.

RELATING TO LABOR.

Authorizes the Director of Labor and Industrial Relations or the Director's designee to issue and serve on an employer a stop-work order prohibiting the use of employee labor by the employer until the employer complies with the provisions of section 386-121, Hawaii Revised Statutes.  Establishes penalties, enforcement, and protest procedure related to stop-work orders.  (HB208 HD1)

PROPOSING AN AMENDMENT TO ARTICLE I, SECTION 2, OF THE CONSTITUTION OF THE STATE OF HAWAII TO INCLUDE ACCESS TO CLEAN DRINKING WATER, EDUCATION AND HEALTH CARE AMONG THE INHERENT AND INALIENABLE RIGHTS OF INDIVIDUALS.

Proposes a constitutional amendment to ensure access to clean drinking water, meaningful health care, and a quality education are among the inherent and inalienable rights of individuals.

RELATING TO CRIMINAL HISTORY RECORD CHECKS.

Adds the Child Support Enforcement Agency and the Departments of Taxation, Human Services, and Labor and Industrial Relations to the list of agencies that are authorized to conduct criminal history record checks on employees, prospective employees, and contractors that have access to federal tax information.

RELATING TO HAWAII STATE IDENTIFICATION CARDS.

Allows any satellite city hall in any county with a population of more than seven hundred thousand persons to issue Hawaii state identification cards.  Requires a report to the legislature.

RELATING TO ABUSE OF FAMILY OR HOUSEHOLD MEMBERS.

Makes it a class C felony for abuse of a family or household member who is younger than 14 years of age.

Exempts active members of the Hawaii emergency management agency and county emergency management agencies from jury duty.

RELATING TO PUBLIC AGENCY MEETINGS.

Allows board members to transmit government records to other board members under specified conditions.

RELATING TO COMMUNITY MEETINGS.

Amends conditions under which two or more members of a board may attend an informational meeting or presentation on matters relating to official board business.  Allows members of a county council to attend such meetings or presentations without limitation on the number of attendees.

RELATING TO CRIMINAL DEFENDANTS' FITNESS TO PROCEED.

Provides that the court may appoint 1 qualified examiner, rather than 3, to evaluate a criminal defendant's fitness to proceed in a felony case.

RELATING TO LIMITATION OF ACTIONS FOR SEXUAL ASSAULT.

Extends the period during which a victim of child sexual abuse may bring an otherwise time-barred civil action against the victim's abuser or an entity with a duty of care.

RELATING TO SEXUAL ASSAULT.

Requires annual reporting to the legislature by the AG of statistical data pertaining to the testing of sexual assault evidence collection kits.  Provides certain rights to sexual assault survivors.  Institutes mandatory testing requirements in accordance with AG guidelines.  Requires AG to report to 2018 legislature on the progress of implementing AG guidelines.

RELATING TO INDUSTRIAL HEMP.

Makes modifications to the Industrial Hemp Pilot Program, including allowing an application to grow industrial hemp to be submitted at any time during the year in which the applicant plans to grow industrial hemp.  (HB96 HD1)

Status

RELATING TO JURY TRIAL.

Increases the threshold value in controversy requirement for jury trials in civil cases at common law from $5,000 to $10,000.

DECISION MAKING TO FOLLOW

 

Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing.  Testimony should indicate:

·     Testifier's name with position/title and organization;

·     The Committee(s) to which the comments are directed;

·     The date and time of the hearing; and

·     Measure number. 

 

While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may be distributed to the Committee after the hearing.

WEB:     For testimony less than 10MB in size, transmit from http://www.capitol.hawaii.gov/submittestimony.aspx.

 

Testimony submitted will be placed on the legislative website.  This public posting of testimony on the website should be considered when including personal information in your testimony.
